Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to pass an order or orders more particularly one in the nature of Writ of Mandamus declaring the action of the respondents herein, in not releasing the 12 years Special Grade/Stagnation increment to the petitioner taking the service of 12 years in both the regions in previous and present regions despite filing a representation dt. 22-2- 2003 is arbitrary, illegal and consequently direct the respondents to release the 12 years Special Grade/Stagnation increment to the petitioner taking the service of 12 years in both the regions in previous and present regions and pay the arrears of salary to the petitioner duly fixing his pay from the date of his entitlement to draw Stagnation increment. Operative part

The petitioner was appointed as a Driver in APSRTC in the year 1987. His services were regularized with effect from 01-04-1988. On his request, he was transferred to Dilsukhnagar Depot. The grievance of the petitioner is that even though he was completed 12 years of service, Special Grade/Stagnation increment was not given to him. In this regard, the petitioner gave a representation dated 22-02-2003 but the same has not been considered by the respondents. Whether he works in one depot or any other depot, it makes no difference. Total service rendered in the Corporation has to be taken into consideration. In such view of the matter, a direction can be given to the respondents to consider and pass appropriate orders in giving Special Grade/Stagnation increment to the petitioner in pursuance of his representation dated 22-02-2003. The writ petition is disposed of directing the respondents to pass appropriate orders on the representation dated 22-02-2003 made by the petitioner within a period of four weeks from the date of receipt of a copy of this order. In the circumstances, no costs. 9th JULY, 2004.
