6. Considered the submissions of the learned counsel for the petitioners and learned Assistant Government Pleader for Revenue appearing for the respondents

The case of the petitioners is that they are the successors- in-interest of the original inamdar by name Balwath in respect of the land to al extent of Acs.8.28 guntas in Sy.No. 159 and an 3 CVBR,I w.P Nos. 27444 of 2021, 30925 oI 2023,20897 o1 2024 extent of Acs.3.0O guntas in Sy.No. 160 situated at Maddulapalli Revenue Village of Khammam Rural Mandal, Khammam Distnct. It is stated that the names of the petitioners' predecessors-in-intere st are recorded as inamdars as ,per provisions of the Telangana Abolition of Inams Act, 1955 (for short, "the Act, 1955") and as on the date of vesting i.e, on

01.11.1973, the petitioners' predecessors-in-interest were in possession of the subject property. It is stated that the petitioncrs submitted application, dated ' 01.Og.2Ol7 for issuancc of Occupancy Rights Certificates to an extenl of Acs.26.14 guntas, forming part of Sy.Nos.159 and 160 of Maddulapalli Village is pending. It is further stated that in terms of the provisions of lhe Act, 1955 and the rules rhade thereunder, they are entitled for issuance of the Occupancy Rights Certificates over the subject property. It is also stated that the respondents by manipulating the records and creating fraudulent Occupancy Rights Certificates, as if they were issued by the competent authority in their favour, have started interfering rvith the peaceful possession and also made applications by relying on fraudulent certificate for mutation of their names in the revenue records. It is further case of the petitioners that acting on the said a applicaLion, reply uide Memo No.B213521 12022, dated lO.lO.2O23, has been issued to the petitioners, wherein it is stated as under:- "As per the above, we are here to provide the below mentioned information as requested by Shri.G. Moses Christofar, R/o- H-No. 6-1-193/301, Om Sai Brindavan, VDO's Colony, Khammam.

It is the contention of the learned Counsel for the petitioners that as per the information furnished by the Revenue Divisional Officer, Khammam District, uide memo dated 1O.1O.2O23, the files relating to issuance of the Occupancy Rights Certilicates in favour of the respondents are not available. In the absence of availability of the said {i1es which are in the nature of permanent reeords, the respondents are not having any right to claim that the Occupancy Rights Certihcates wcre issuecl from thc office of the Competent elthority and they are entitled to mutate their names in the revenue records and for consequential issuance of pattadar passbooks. It is further contended that questioning the alleged Occupancy Rights Certificates relied by the respondents uide in Rc.No. A2llnamsl2395 l2O1O, dated 24.Il.2OlO and Rc.No.A2/Inamsi 31/2008, dated 14.03.2008, Lhese u,rit pctilions are liled.

Admittediy, the petitioners are questioning the Occupancy Rights Certihcates issued in favour of the respondents on the ground that the same are not emanated from the office of the Revenue Divisional Officer, Khammam District and they are created fraudulently. If the petitioners are aggrieved by the issuance of the Occupancy Rights Certificates, they are entitled 6 cvBR, I c'', W .P .Nos. 27 444 of 2021 , 30925 of 2023,20897 ol 2024. to avail the remedy of a statutory appeal under Section 24 of rhe Act, 1955. The appellate authorit5r constituted under the provisions of the Act is conferred with powers to examine the records with regard to authenticity of tfie Occupanc] Right Certificates issued in favour of the respondents. It is settled law that when alternative efhcacious remedy is available or the statute under which the action complaint has been taken, itself contains a mechanism for redressal of grievance, a writ petition is not a remedy to resolve the issues which are required to be adjudicated on the basis of evidence.

In PHR Invent Educational Society vs. UCO Bankl, the Hon'ble Supreme Court observed as follows: "23. lt could thus be scen that, this Court has clearly held that the High Court q'ill ordinarrly not entertain a petition under Arlicle 226 of the Constitutior.r if an effective remedy is availabte to the aggrieved person. It has becn held that this rule applies with greater rigour in matters involving recovery of taxes, cess, fees, other typcs of public money and the dues of banks and other financial institutions. 'l'he Court clearly observed that, while dealing with the pctitions involving challcnge to the action taken for recovery of the public dues, etc. the High Court must keep in mind that the legislations enacted by parliament and State Legislatures for recovery of such dues are a codc unto themselves inasmuch as they not only contain comprehensive procedure for recovery of the dues but also envisage constitution of quasi_ judicial bodies for redrcssal of the gricvance of any aggrieved person. It has been held that, though thc powers of the High Court under Artrcle 226 of the Constitution are of widest amplitude, still the courts cannot be oblivious of the rules of self- imposed restraint cvolved by this Court. In vie$r of thc above discussion, since the petitioners are having alternative and efficacious remedy to approach the appellate authority, this Court without expressing any opinion on merits o[ the matter, deems it I I appropriate to relegate the petitioners to hle an Apperil before the appellate authority, if they are aggrieved by the issuance of Occupancy Rights Certificates in, favour of the respondents, in accordance with law. [n thc evenl of filing such appeal, the appellalc authority shall consicler ti-re same strictly upon verihcation of the records rclating to issuancc of the Occupancy Rights Certillcates over the disputed land in Sy.Nos.159 and 160 of Maddulapalli Village, as u,ell as the entitlement of the parties herein fcrr issuancc of the Occupancy Rights Ccrtificates as per thc provisions of the Act, 1955 and the rules rnacle thereunder, and dispose of the same, without being influenced by any observatior-ts made by this Court or the Memo No.B2 I 3521 12022, daLed IO.10.2023 issued by the Revenuc Divisional Officer, Khammam District.
