LAKSHMAN WRIT PETITION No.36264 of2O2L ORDER: Heard learned counsel for the petitioner, learned Assistant Government pleader for Municipal Administration and Urban Development appearing for respondent No. 1, learned Assistant Government pleader for Revenue appearing for respondent Nos.2 and 4 and Sri Kadaru Prabhakar Rao, learned Standing Counsel appearing for respondent No.3. perused the record.
2. In view of the nature of relief sought by the petitioner, this Writ Petition is disposed of at ttre admission stage dispensing with notice to respondent Nos.S to 18.
3. Petitioner herein is claiming that he is the absolute owrrer and possessor of house bearing No.22_7_10g on plot No.29 admeasuring 325 Sq.yds situated at Medipalli VillaAe Shivar, Kasipelti hamlet interior locality, within respondent No.3-Municipality, on the st.g1Clt t _of a ) W.P.N o.36264 of202t regrstered sale deed bearing document No.27O1 of 2OI4, dated 30.O7.2014. Respondent Nos.S to lg constructed compound wall without obtaining prior permission from respondent No.3. They obstructing the way/road reaching to the petitioner,s house. Therefore, he has representation, dated lI.OS.2O2L submitted a respondent No.3 w.ith a request to take action against respondent Nos.S to 1g. Despite receiving ald acknowledging the said representation, respondent No.3 did not act upon the same. Aggrieved by the said inaction of respondent No.3, petitioner filed the present writ petition.
4. Learned counsel for the petitioner also placed reliance on the information furnished by respondent No.3 to show that respondent Nos.S to lg have constructed the compound wall without obtaining permission from respondent No.3. KL,J W.P.No.36264 of 2021 3

Whereas, Sri Kadaru prabhakar Rao, learned Standing Counsel appearing for respondent No.3, on instructions, would submit that respondent No.3 will inspect the site, consider the representation, dated LL.O5.2O2I and if the allegations made by the petitioner are found to be correct, respondent No.3 will take action against respondent Nos.5 to 1g strictly in accordance with the procedure laid down under the Telangana Municipalities Act, 2OL9 (for short the Act, 2O19) by putting t].e petitioner and respondent Nos.S to 1g on notice and affording them an opportunit5r of hearing.

In the light of the said submissions, this Writ Petition is disposed of directing respondent No.3 to consider the representation, dated 1L.OS.2O2I, inspect the site and if the allegations made by the petitioner are found to be correct, he shall take action against respondent Nos.S to 1g strictly in accordance with the procedure laid down under the Act, 2Ol9 by putting the petitioner a,d respondent Nos.S to 1g on notice and ( t(( .l W.P.No.362 64 of20Zi K 4 affording them an opportunity of hearing. He shall complete the said exercise within a period of six (6) weeks from the date ofreceipt ofa copy ofthis order. No costs.
