THE HON’BLE SRI JUSTICE GODA RAGHURAM AND THE HON’BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.8059 of 2010 ORDER (Per the Hon’ble Sri Justice Goda Raghuram): Proviso (iii) of sub-Section 2 of Section 3 of the Andhra Pradesh Motor Vehicles Taxation Act, 1963 (for short ‘the 1963 Act’) as substituted by A.P Ordinance No.2 of 2010 is assailed in this writ petition on the ground that A.P Ordinance No.2 of 2010 is contrary to the provisions of Section 3 (1) of the 1963 Act and Section 2 (28) of the Motor Vehicles Act, 1988. Ordinance No.2 of 2010 having lapsed was reintroduced as Ordinance No.5 of 2010 and thereafter enacted as A.P Act No.11 of
2010. In the above circumstances, this writ petition challenging the provisions of Ordinance No.2 of 2010 does not survive for adjudication and the writ petition is accordingly dismissed, however no costs.
