VIJAYSEN REDDY i WRIT PETITION No.28420 OR 2025 ORDER: (ORAL) This writ petition is filed by the petitioner seeking to declare the action of respondent authorities in not considering its representation dated 05.08.2025 and 13.08.2025 for mutating the land admeasuring 96 square meters and [ 94 square meters in T.S. Nos.36 and 30 in favour of Sri Devi Bagh Temple, as being illegal, arbitrary and violative of Articles 14, 21,. and 300-4 of the Constitution of India.

2. Heard Mr. D. Kaval Kumar, leamed counsel for the petitioner, and Mr. Midde Arun Kumar, leamed standing counsel for the GHMC, appearing for respondent Nos.2 to 4.

3. The case of the petitioner is that Sri Devi Bagh Temple is an ancient place of worship and had been in existence for more than 667 years. The temple was registered under Section 43 of the Telangana Charitable and Hindu Religious Institutions and Endowments Act 1987. As per the Muntakab Kitabul Waqf (Abstract of Endowment), File No.85/2/1335 Fasli (1953 A.D.), 2 the temple is in possession of 2174 square yar<l , which was confirmed through a comprehensive survey con,l rcted by the Department of Land Records (DDLR) in File No \3124812024. The Survey report records the following extents: (i 1554 square meters in T.S. No.3, which comprises of temple cremises and surrounding endowment owned rented houses, ) 90 square meters in T.S. No.36, comprising of endowment pr: terties let out for rent, under the management of the Endowmen Department, (iii) 194 square meters in T.S. No.30 comprises rf open area directly in front of the temple gate, used for relip i )us purposes, congregation of devotees and temple events. Hov ever, in T.S. No.3 it is correctly recorded as 'G-Temple', in T.L No.36, it is wrongly recorded as 'Abadi Land', though structur( s on the land are endowment structures, and in T.S. No.30, Its wrongly recorded as patta land in the name of one Mr. Kashi I rnda Rao S/o. Babu Rao despite no private individual has :ver claimed possession for the past more than thirty (30) years.

4. [t is submitted that representations dated 05 .08.2025 and

13.08.2025 have been submitted by the petitioner - society to 3 I i respondent authorities for correcting revenue records and also for implementing orders passed in I.A. No.687 of 2022 in A.S. No.104 \ of 2020 and I.A. No.504 of 1996 in O.S. No.332 of 1996. As there is inaction on the part of respondent authorities in considering their representation, they are constrained to approach this Court.

5. Learned standing counsel for the GHMC submitted that representation of the petitioner will be considered, and pass orders, in accordance with law.

Recording the submissions of the learned standing counsel for the GHMC, the writ petition is disposed of, directing respondent authorities to consider the representatlon of the petitioner dated 05.08.2025 and 18.08.2025 for mutating land admeasuring 96 square meters and 194 square meters in T.S. Nos.36 and 30 in favour of Sri Devi Bagh Temple, and pass orders, in accordance with law, by issuing notice to the petitioner and all other concemed/interested persons, by affording opportunity of hearing to them, within a period of four (4) weeks from the date of receipt ofa copy ofthis order.
