JUSTICE TIRUMALA DEVI EADA l.A.Nos.2 and 3 of 2025 in/and CRIMINAL P ETITION No.12080 ot 2O25 COMMON O DER This Criminal Petition is filed by the petitioners/accused Nos.1 and 2 under Section 528 of BNSS, 2023 seeking to quash the proceedings against them in C.C.No.303 of 2025 on the file of the Principal Judicial First Class Magistrate, Mahabubnagar, registered for the alleged offence punishable under Section 85 of the Bharatiya Nyaya Sanhita, 2023 and Sections 3 and 4 of Dowry Prohibition Act, 1961.
2. lt is submitted by learned counsel appearing for the petitioners/accused Nos.and 2 as well as respondent No.3/de faclo complainant that during pendency of the present Criminal petition, the parties have compromised the matter and accordingly, l.A.Nos.2 and 3 of 2025 have been filed to record compromise between them and to compound the offences.
3. The learned Additional public prosecutor has opposed the said compromise petitions. 4 Perused the affidavits filed by the de facfo complainant in l.A.Nos.2 and 3 of 2025 which disclose that she has willingly 2 (rb 1)080 20)5 consented for compromise. Since the parties were willing to enter into compromise, they were given a chance to settle the matter by appearing along with their respective counsel beforer the High Cou( Legal Services Committee for the State of Telangilna vlde orders dated 17 09.2025 passed by this Court. 1. It is submitted that the marriage of the petitioner herein on 01.02.2024 as per Muslim rites and customs. Subsequently the 3.d respondent joined the 1st petitioner to lead marital life. But due to the mis understandings they could not adjust together in the connection. The 3d respondent herein lodged a complaint before the 2nd r<:spondent, who is' turn registered a case in FIR No.16 of 2025, on dt.rl!).o2.2025 for the offence under Sec 85 BNS, 3 & 4 DP Act.
2. It is submitted that during the pendency of the ,lbove said case, at the intervention of t-he elders and well wishers, the' matter has been amicably settled and to that effect the 3'd respondent arrd the 1st petitioner have decided to Iive separately and the 3'd respondent has agreed to withdraw the above said case uncond itionally. In viera' cf the above said settlement, no purpose would be served in continuing the said proceedings. In view of the above it is prayed that this Hor'ble Court may be pleased to record the compromise and quash the proceedings in C.C.
