A consequential prayer is made to direct the respondent Nos.4 and 5 to conduct and demarcation in the aforesaid land of the petitioner basing on the F_Line application No.DER0221OO706406 of the petitioner dated

2. Heard Sri Dinesh Reddy, learned counsel representing Sri Rapolu Bhaskar, learned counsel for the petitioner on record and Sri H.Rakesh Kumar, Learned Assistant Government Pleader for Revenue appearing for respondent Nos. 1 to 5.

Learned counsel for the petitioner submits that the petitioner has Iiled an F-line application dated,24.lO.2O2l uid.e File No.DERO22LOO7O64O4 for conducting survey to an extent of 15O square yards open plot of the petitioner in Survey NO.4O9 (herein after referred as "subject land,,) situated at Ibrahimpatnam Town and Manda,l ald the same has not been 2 conducted. Since no action has been takerr to the F-line appiication submitted by the petitioner, the pres,r it Writ Petition is filed

Learned counsel for the petitioner further sr bmits that the petitioner had purchased the subject lald unrl :r a registered sale deed bearing document No.1438 of 1993, dat:d 16.08.1993, on the hle of the Sub-Registrar, Ibrahimpatnar r, for valuable consideration. Even since, the petitioner has t,t en in peaceful possession amd enjoyment 'of the said propert / without any interruption from aly qua-rter. In order to h r re clarity with respect to boundaries ald for establishing c.eaf tit1e, the petitioner made an application by paying requisite fee, requesting respondent Nos.4 and 5 to conduct a survey and effect sub division of her plot. However, de; rlte receipt of requisite fee, respondent Nos.4 and 5 have not I cted upon the said request. Left with no afternative ald bein 1 aggrieved by such inaction, the petitioner is constrained tc approach this Court by way of this Writ Petition.

Learned counsel for the petitioner furthr,t submits that though the petitioner's request, along with the r :quisite online application fee, has been accepted, the same hasr not been acted upon by the respondents. Consequently, the pe .i -ioner is facing {ftiF-=rygz '/ 3 difficulty in establishing arld identifying the tile and boundaries of the subject property. Under these circumstances, the petitioner seeks a direction to respondent Nos.4 ald 5 to conduct the survey of the subject propert5r. 6 . Learned counsel for the petitioner reiied upon the judgment passed by this Court in W.P.No.481l of 20 11 and batch, dated 28.04.2016 and submits that this issue pertaining to this matter has been addressed by this Court through the said order.

Learned Assistant Government Pleader for Revenue submits that the respondents had issued a circular uide Ref.No.N2/1741 /2OlO, dated 18.05.201O, which categorically establishes that the survey contemplated therein is confined only to agricultural lands and not in respect of commercial plots. Therefore, the plea of the petitioner for conducting survey does not fall within the scope of the said circular and is misconceived. It is further submitted that the petitioner's plot fa1ls within the limits of Municipal Corporation, arld as such, the survey cannot be undertaken by the Revenue Authorities. Instead, it is for a licensed surveyor duly authorized by the Corporation to conduct the survey of the petitioner's larrd. As such, sought for dismissa-l of the Writ Petition. , 4 B. Having heard the learned counsel app :aring for the petitioner and the iearned Assistalt Governmr: rt Pleader, this Court is not inclined to go into the merits or lemerits of the case. However, this Court considers it approprtz te to direct the respondent Nos.4 and 5 to consider representation, in terms of the order passed b. re petitioner's ' this Court in W.P.No.4811 of 2011 and batch, dated 28.04,. 016, and take necessa_ry action thereon by passing approprLr .te orders ald communicate the same to the parties. It is m:.r e clear that, if the petitioner is aggrieved by the order so pasrr ed, it shall be open to them to avail the remedy of appeal in ,l :cordance with law and in terms of the circular referred to above
