3. The facts of the case in brief as stated are that on
18.03.2020, the petitioner submitted a lease application for Stone and Metal with an extent of 4-80 hectares in Sy.No.255 of Bommanapad Village, Narayanpet Mandal 2 and Distr-i.-:1. The Tahsildar, after enquir_r submittcd his -c.port through Lr'No'B/r38'l /2o2o datecl o1.oz.2o2o holdir 1: that the sad area is Gor.crnmcnt land aud there is no h: l,italion rvithin 2 KMs fr.ont main road and as such sul,r:titted his No Objection rcr accord permission for grant ol. quarry lease. However, tJtr: flssjslnr-rt DrrccLor has not pror r:edecl with the quarry application of the petitioner. In the nrcantrme, the Government through G.o.Ms.No.26 In<r,stries a,d Commerce [)epartment dated 31.03 .2022 ztmended the ;a*Gf- :?,'';5.e// 3 'l'elangana Mir-ror Mineral Concession Rules, 1966. As per the amended Rule 12 sub-rule (1) is as follows: "Th.e Minor Mtneral Concession except orclitarg sand and ctreas reserDed under Rule 9- A shall be granted through ctuction. The procedure for grant of Minor Mineral Concession in Gouernment lands through auction and the procedure _fo, grant of Minor Mineral Clonces.siorrs in patta lands shall be prescibed by the State Gouernment. All appltcations for ntinor minerals receiued pnor to the date of comn-Lencenlent of these amendments to 'l'elangana Minor Mineral Concessions Rules, 1966, shall become ineligible. "
4. It is submitted that the said order will come into effect from 01 .O4.2022 onwards. The main grievance of the petitioner is tl.rat though it is specifically stated that the amended rule is applicable from O 1.04.2022, however the respondent authorities did not process the quarry application of the petitioner dated 18.03.2020. In that regard, petitioner made a representation on 06.06.2023 to the respondent authorities and requested to grant quarry lease license at the earliest.
