Judgment

It is submitted by the learned counsel for the petitioners that in this writ petition, the petitioners have questioned the validity of the notification issued under Section 4(1) of the Land Acquisition Act, 1894, which was published in the Andhra Pradesh Gazette No. 65 of 1997 dated 26.8.1997. It is further submitted that the said notification was challenged before this court in Writ Petition Nos. 33862 of 1997 and 524 of 1998 and this court quashed the said notification on the ground that the State failed to notify the substance of Section 4(1) notification in the mode and manner mandated by that section. Inasmuch the lands of the petitioners are also covered by the said notification, following judgment of this court W.P.No.33862 of 1997, dated 4.6.1999, this writ petition is also allowed and the notification issued under Section 4(1) of the Land Acquisition Act to the extent of the lands of the petitioners is hereby quashed. But, however, this order will not preclude the respondent- authorities to take de novo steps to acquire the land in accordance with law. No costs. _____________________ 15.3.2007 REDDY, J. R.SUBHASH VR
