Briel- facts of the case as stated are that petitioners claims to be owners of land admeasuring Ac.l-2O gts., in Sy.No.l2O at Kommepalli Village, Sathupalli Mandal, Khammam District who are claimants in LAOp.No.S of 2019. Respondent No,2 sent requisition to acquire the land to an extent of Ac.68O- 07 gts., for ttre purpose of JVR OC-II mining in the village limits of Kommepalli, Sathupally Mandal in the year 2009. ThereaJter, notification was issued for acquiring Ac.4B9-O4 gts., of land and accordingly irward was passed under Section 1 1 of Land Acquisition Ar:t, 1,894 granting Rs.3,a8,935/ towards compensation. per acre. Aggrieved by the same, the land losers filed LAOP.No.619 of 2Ol4 on the file of Principal District and Sessions Judge, Khammam and thereaJter, the sime was sub- divided based on Survey numbers and that petitioner,s subject property becarne part of LAOP.No.S of 2019 and the petitioners have filed the claim statements in the said LAOP and the same is pending for adjtrdication. Thereafter, land losers approached Lok Adalat and ttLe compensation amount was enhanced to Rs. 10,95,00O7/- per acre. However, compensation q-as not paid till date even though the lalds were acquired in the year 2OI3. Accordingly, petitioners made a representation on 25. IO.2024 to 3 the District Collector, Khammam stating that Rs.25,OO,OOO/- per acre was paid to land losers and same compensation would be paid to them. Since, no response is forth coming, petitioners have frled the present writ Petition 4 Today when the matter has been taken up for hearing, learned counsel for the petitioner submits that in similar circumstances this Court in W.P.No.12837 of 2023 dated
28.O4.2023, passed the following order:- "S.Hauing regard to the same, the Wit petition is disposed of and respondent -l[o.5 is directed to deposit tte decretal amount in tertns of the order and decree, d.ated 30.03.2011, passed in O.P.No.65 of 2OO9 bg the Senior Ciuit Judge, GaduLal, to the credit of E-P-No'S of 2023 in O.P.No.65 of 2009 on the file of Senior Ciuil Judge, Gadwa| as expeditiouslg as possible, at ang rate uithin a peiod of four (4) months from the date of receipt of a copg of this order. Recorrling the submission made by learned counsel appearing on r:ither side ar1d in terrns of order passed by this Court in W P.No. l283Z of 2023 dated 28.04.2023, this writ petition is disposed of directing the respondent authorities to deposit the cle<:reetal amount in terms of the order and decree, passed in L.A.O.P No.5 of 2OI9, on the f,rle of principal District and Sessions Judge at Khammam, to the credit of L.A.O.p No.S of 2019, as expeditiously as possible, at any rate within a period of four (4) months from the date of receipt of a copy of this order.
