SRINIVAS, AGP FOR HOME Counsel for the Respondent Nos. 3 to 5:--- The Court made the following: ORDER THE HONOURABLE SRI IUSTICE N.V.SHRAVAN KUMAR I^rRIT No.28051 of 2025 ORDER: Heard learned counsel for the petitioner and M.Srinivas, learned Assistant Government Pleader for Home appearing for respondent Nos.1 and 2- With their consent this writ petition is taken up for disposal at the admission stage itself.

This writ petition is filed seeking following prayer:- "to direct tlrc respondents to prouide police protection to the petitioner nnd his fanily members and their suit schedule property in suluey No.13 to an extent "f Ac.0-035 situated at Ramakrishnapu.ram Village, Bhadrndri Kothaguclem Village, Turubaka Panchayathi, Dammugudem Mandal, Bhadradri Kothagudem District."

Brief facts stated in this writ'petitioll are that petitioner claims to be owner and possessor of lancl admeasuring to an extent of Ac.0.35 guntas in S)r.No.13, situated at Bhadradri Kothagudem Village, Turubuka panchayati Dammagudem Mandal, Bhadradri Kothagudem District, having acquired the same through sada will deed dated 73.09.1,gg7. The case of the petitioner is that respondent Nos.3 to 5 with an intention to grab the subject property are creating false and fabricated documents and are trying to dispossess the petitioner from the subject land. Hence, the petitioner has filed O.S.No.112 of 2021,, before the Special Assistant Agent and Sub Divisional Magistrate, (Mobile Court), Bhadrachalam (herein after referred as'Trial Court'). The Trial Court uide order dated 23.01,.2021. in I.A.No.120 of 2021, in o.S.No.112 of 2021., granted interim injunction order and restrained the respondent Nos.3 to 5, d3i '1. I I t 2 t-\ their henchrnen or anybocly on their behalf from interfering with the petitioner's p,eaceful possession over the subject land. Inspite of the aforesaid order, on 02.11-2.2023, respondent Nos.3 to 5 tried to dispossess the petitioner from the subjr:ct land, hence, the petitioner filed I.A.No.5 of 2023 in I.A.No.120 of 202'I.. in O.S.No.712 of 2021., seeking direction !o the the Station House Officer, Dumrnagudem Police Station, to give police protection to petitioner as well as to the subject property. It is further submittcd that though the I.A.No.5 of 2023 was filed in the month of December,2023 till date the same had not been decidecl. Further case of the petitioner is that on '11.06.2025, petitioner made a repr:esentation and requested respondent authorities to provide the police proteclion to the petitioner and subject property, however, the same is not consiclered. Aggrieved by the same, this writ petition is filed.

Learned counsel for the petit'ioner submits that subsequent to the filing of I.A.No.S of 2023 in I.A.No.1ZO of 2021 in O.S.No.112 c>f 2021., there is no presiding officer continuouslv hearing the matters ancl since the RDO/Sub Collector are in-charge magistrate, they are conducting the trial only on Tuesdays. It is further submitted that the petitioner filed I.A.No.S of 2023 on

23.12.2020bhd since then the same is pending and prav this Court to direct the respondent authorities to consider the petitioner's representation dated 11,.06.2025 and provide police protection to the petitioners as well as to the subject pjoperty;, n . i.

Learned Assistant Government Pleader for Home placed on record instruction issued by the Sub Inspector of Police, Dummugudem police {ttb i i. a n I .-,.i Statiory Bhadradri Kothagudem District, wherein it is stated that though the petitioner obtained interim injunction order in I.A.No.120 of 2023 in O.S.No.112 of 2021, from the trial court, however, no specific orders have been issued to provide police protection to the petitioner or subject property. It is further submitted that petitioner ought to have approached the trial court and had obtained orders for police protection.

Recording the submissions made by the learned counsel appearing on either side, without expressing any opinion on the merits of the case and since the I.A.No.5 of 2023 in I.A.No.720 of 2021 in o.s.No.112 of 2021, is pending before the kial court, this Court deems it appropriate to dispose of the writ petition directing the trial court to expedite hearing of I.A.No.5 of 2023 in I.A.No.120 of 2027 in o.s.No.112 of 2021 and dispose of the same as expeditiously as possible. With respect to petitioner's representation dated

11.06.2025, the respondent authorities are directed to consider the said representation and pass orders strictly in accordance with law.
