With their consent, this writ petition is being taken up for disposal at the admission stage itself.

This writ petition has been filed seeking the following prayer:_ "to declare the actio.rt. of the respondent police particularly 5*, respondent in not regs^tering the Flk basing on the comptaint "of petitioner dated 26.03.2025, eoen .the S,rt, reipondent in ocript iy ilr" same, is illegal, arbitrary and against the principles uy ,rtuA flrtir" and also ttiolation of apex couit rulings held in Lahtha Kumari Vs Goat. of l_lp andors attd as well as ntis ona ,onrrquently direct the respondents police to entertain the complaint antl register the FlR.-

3. Brief facts stated in this writ petition are that petitioner claims to be master in Astrology and he is engage in performing pooja as remedies to the clients who approached him. The petitioner is permanent resident of Hyderabad, staying at Jillelaguda, Meerpet. It is further submitted that the Petitioner is staying in Hyderabad for 15 days and another 15 days he is staying in vijayawada. The case of the petitioner rs that on 2s.o3.2025, between 3 PM to 4 pM, some persons entered into his chambers and detained him for extracting money by using physical assault and threatened him with dire consequences and demanded an amount of Rs.10,00,000/_ andforcibly taken tfuee (03) cheques of Federal bank, Athmakuri tsrancfu Guntur District. The said incident was recorded in CCTV footage. Thereafter, the petitioner on 26.03.2025 made complaint and requested respondent No.5 to take action 2 against the said persons. However, till date no action is initiated' Aggrieved by the same, this writ petition is filed.

Learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 5 placed on record instructions issued by Sub-Inspector of Police, Banjara Hills Police Station, Hyderabad, \Alherein it is stated that petitioner's complaint dated. 26.03.2025 was registered on 05'05 2025 and GD entry ztide petition No.FIYD/BH_HyD / 050525 / 00928 dated 05.05.2025 was made and during the course of the enquiry, the respondent No'5 sent his staff to the petitioner's residence and even tried to contact hirn over pl1one. It is further submitted that petitioner neither responded to the phone calls nor had produced arry relevant evidence before the enquiry officer' Hence, on 7L.09.2025, the petitioner's complaint dated 26.03.2025 n'as closed as 'Lack of evidence' and the same was comrnunicated to the petltioner through SMS'

5. Learned Assistant Government Pleadcr for Home further submits that instead of appearing before the respondent No 5 and submitting relevant evidence, petitioner had filed the writ petition with false allegations'

6. Per contra, learned counsel for the petitioner subrnits that the petitioner is very much diligent in pursuing his case ancl pray this Court to direct the respondent No.5 to re-examine the petitioner's complaint dated

26.03.2025 and register FlR.

Recording the submissions made by learned counsel appearing on either side, without expressing any opinion on the merits of the case and since the petitioner is ready to co-operate and submit relevant evidence, this Court 3 deems it appropriate to dispose of the writ petition granting Iiberty to petitioner to approach the respondent No.5 0n 19.09.2025 at 11.00 AM and submit relevant evidence and thereafter, the respondent authorities are directed to re-examine petitioner's complaint dated 26.03.2025 a.d after examining the evidence, respondent authorities are directed to follow due procedure as contemplated under law.
