MADHAVI DEVI WRIT PETITIO N No.2789 0 0F 2025 ORDER: This Writ Petition is filed seeking a direction to the respondents to consider the representation of the petitioners dated l6'03'2021 and

25.08.2025 and to return the land encroached by respondents No'5 to 7. to the extent of Acs.3.36 guntas in Sy'No 200, situated at Peddamberpet Village an<l Mandal, Ranga Reddy t)istrict' to the petitioncrs.

Learned counsel for the petitioners has drawn the attention of thisCourttovariousdocumentslrledalongwiththewritaffidavitto dcmonstrate that a survey was conducted and it was obselved by the survey authorities that there is an enctoachment of Acs'3 '36 guntas in Sy.No.200 situated at Peddamberpet Viltage, Abdullapurmet Mandal' Ranga Rcddy District, by the forest officials. It is subrnitted that in spite of the said survey reports and panchanamas, the respondents have not taken any action to retum the land of the petitioners and therefore, the petitioners were constrained to frle a fresh representation dated 'f,. 2 TMDJ \ p-27a90 1025

25.08.2025, but the respondents have not considered the same so far Challenging the said inaction, this Writ petirion has been filed. 3. Learned Govemment pleader for. Forests, appearing for respondents No. I & 4 to 7, however, submitted that the earlier surveys were conducted without taking into consideration the objections of Forest Department and therefore, the said repofts cannot be reried upon. He further submitted that the respondents have no objection if a fresh joint survey is conducted and therealter, the respondents would consider the representation of the petitioners and take action in accordance with law.

Leamed counsel for the petitioners also expressed willingness for conduct of fresh joint survey. 5 ' In view of the same, respondents No.2 and 3 are directed to initiate steps for conducting a joint survey i.e., in the presence of both the petitioners as well as the Forest Department. The joint survey shall be conducted within a period of three (03) months fiom the date of receipt of a copy of this order. If there is any encroachment by the Forest Department as established by the earlier survey repofis' then the respondents shall immediately dispose of the iatest representation of the petitioners and return the land to the petitioners expeditiously' preferably within a period of two (02) months lrom the date of such survey'
