Judgment
This Criminal petition under Section 482 Cr.P.C. is filed by the petitioner - accused No.1 seeking to quash the proceedings in C.C.No.430 of 2009 on the file of III Metropolitan Magistrate, Cyberabad, arising out of Crime No.776 of 2009 of Uppal Police Station, Cyberabad, registered for the offence punishable under Section 353 IPC.
Heard.
The allegation against the petitioner is of quarrelling on the street along with some others and when the de facto complainant – police constable and some others tried to interfere, scolding and assaulting the de facto complainant etc. The main contention of the learned counsel for the petitioner is that admittedly about 10 to 15 persons were quarrelling and only two are charge sheeted and that there is delay in giving the complaint, all these questions are not sufficient to quash the proceedings, as apparently some incident has taken place. Hence, I see no merits in this petition and the same is liable to be dismissed.
