2. Heard Sri G.Rajasekhar Reddy, learned counsel for the petitioners, Sri L. Ravinder, learned Assistant Government Pleader for Revenue appearing for the ofhciai respondents and Sri Chandrsekhar Reddy Ramavarapu, learned counsel appearing for the unofficial respondents and u'ith their consent, this Writ Petition is being disposed of at the admission stage.

Learned counsel for the petitioners -*.culd submit that petitioner No.1 is the owner and possessor of the larrd admeasuring Ac.O.18 guntas in Sy.No.458/A; Ac.0.18 guntas in Sy.No.aSSlB; Ac.0.36 guntas in Sy.No.458 lE and Ac.O.77 guntas in Sy.No.458/U1; petitioner No.2 is the owner and possessor 'of the land admeasuring Acs.2-09 guntas in Sy.No.a58/UU and petitioner No.3 is the owner and possessor of the land admeasuring Acs.2.O9 guntas in Sy.No.458/ LU, situated at Mubaraspur Revenue Village, Doultabad Mandal, Siddipet District. The revenue authorities have also mutated their names in the revenue records and issued pattadar their favour uide Passbooks bearing passbooks in 4 EVV, J wp 27175 2025 Nos.T10050050616; T10050050460 ard't r005005c392, respectively. Petitioner No 4 claims rights t ver the land aCrneasunng Ac. 1.20 guntas in the same survey l umber, whrch was inherited b;. his father late Thumma Lurc I u Reddy rride Family Settlement and Partition, dated 10.04. 990 and the same is implemented by respondent No.S uid< proceedings bearing No.Bl8248/2010, dated 28.01.2011. Lr arned counsel for the petitioners would further submit that earlier, uide panchanama, dated 03.05.2025, survey of Sy.No.458 of Doulatabad Village was conducted in the pr sence of the petitioners and the unofficial respondt t in File No.D/ 138/2025 and accordingly, l-.oundaries u, ere fixed and boundary stones were also laid. Since the petiti, ners have not been satisfied with the said survey report, they 1 led an Appeal on Demarcation by paying the requisite fee. LeaIr ed counsel for the petitioners would further submit that, while t le said Appeal on Dcmarcation is pending before respondent No.S, at the behest of the petitioners, the unofhcial responden s have hled F- Line applications to conduct survey by sub-div:r ing Sy.No.458 and lo demarcate their la-nds situated in th : sub-division numbers of the said survey number and when t re said F Line applications were not considered by the ofhci l respondents, 5 EW,J Wp_27 115 _2025 they were constrained to hle W.P.No.18064 of 2025, which was disposed of oo 27 -06.2025. In compliance with the order passed by this Court, the impugned notice, dated 30.08.2025 was issued by respondent No.6 in File No.W.P.No.l8O6a 12025, dated 30.08.2025. Aggrieved thereby, the present writ petition is filed contending that, while the Appeals on Demarcation is pending for consideration, the unofhcial respondents have obtained the orders in W.P.No.18064 of 2025 by suppressing the facts and the petitioners have got objections in conducting survey of the said survey number and if the survey is conducted without considering the objections, it will go against the interest of the petitioners. Therefore, learned counsel prays this Court to pass appropriate orders. 4 . Learned Assistant Government Pleader for Revenue would submit that the impugned notice was issued directing the petitioners to present along with their pattadar passbooks on 1O.O9.2O25 at 1O:00 a.m. and this Court has granted interim stay of all further proceedings pursuant to the said survey notice till 25.09 .2025 and subsequently, the same has been extended from time to time. Learned Assistant Government Pleader for Revenue would further submit that since the Appeal 6 EVV, J \\p 21l75 2025 t. on Demarcation filed by the petitioners is pendi lg, in order to put a quietus to the litigation. he prays this lourt to pass app;opriate C irections.

Learned counsel appearing for the unofhc.r I respondents, on the other hand, would submit that the surve r' purported to be conducted is based upon the directions issut:r by this Court in W.P.No.18064 ot 2025 and the petitiortr rs have also submitted their objections to the impugned not ce in terms of the circular instructions issued by the Commi; ;ioner, Survey, Settlement and Land Records, from time to time

Having heard the learned counsel for 1le petitioners; learned Assistant Government Pleader for Revell le arrd learned counsel for the unofhcial respondents, this lourt, without making any observations on the merits and c emerits of the case, deems it appropriate to direct respondett No.6 to issue fresh notice lo all the concerned, including the retitioners and the unofficial respondents, as the impugned str vey notice has become infructuous due to efflux of time and :ake necessary action dull' takrng note of the objections, if anJ , filed by them and the circttlar inslructions issued by the Commissioner, Survey, Settlement and Land Records, shall cc,: duct survey of - 7 7 EW,J \ p 27 t75 2025 the entire survey number including sub-divisions thereon, strictly in accordance with law as expeditiously as possible, preferably. within a period of 60 days from the date of receipt of a copy of this order. Inscfar as the Appeals on Demarcation frled by the petitioners is concerned, since the survey is purported to be conducted, pendency of the said Appeals on D.-r.catio., shali not have any purpose. It is needless to clarify that uniess the demarcation of the entire survey number is done, the question of sub-division of survey number does not arise. Accordingly, the ofhcial respondents are directed to close the proceedings in Appeals on Demarcation. 7 . With the above observations, this Writ Petition is disposed of. There shall be no order as to costs Miscellaneous petitions, if any pend ing in this Writ Petilion, shall stand closed. SD/- C.
