Counsel for the Petitioners : SRI K.RAM REDDY "' Counsel forthe Respondent Nos.1 & 2 : GP FOR.BEVENUE Counsel for the Respondent No.3 : SRI G.MADHUSUDHAN REDDY, SC FOR GHMC The Court made the following ORDER/ I THE HONtff RABLE SRI JUSTICE N.V. No.734 of 2O2l (para 8t)) vide common orders passed in Writ Appeal No.508, 658 & 734 of 2O11 ar,d 979 of 2013, Writ Petition Nos. 12572 of 2O03 and C.C. No.1084 of 2021 dated 04.O1.2024, present writ pet.ition has beerr liled, with a consequential prayer to direct the respondent No.2 to examine consider and pass appropriate procecdings.

2. The learned counsel for the pctitioners would submit that the petitioners purchzrsed hou sc plots Itom lhe owner o ' the lands vidc respective registered sale deeds and thereafter, have obtained municipal house numbers and are paying municipzLl tax regularly. It is further sutrmitted that sincc the subject pioperties of the petitioners are under litigation of ULC, the petitior.ers availed the opportunity under G.O.Ms.No.455 dated 29.07.2OO2 by paying the .!/\r, l determined amounts therein. The learned counsel for the petitioners has drawn the attention of this Court to the common order dated 'I

04.01.2024 passed in W.A. No.734 of 2O2l by the Hon'ble Division Bench o[ this Court and submitted that so far as the case of the petitioners is concerned the l-lon'ble Division Bcnch had observcd at para No.8O, which reads as under: "W.A.No.734 of 20 1 1

80. Having regard to the facts ald circumstances of the case and the submissions made by the learned counsel on eithcr side, it has been noticed that thc learned counsel for the appellant has raiscd various factual questions rvith respect to the possession of its members over the subject land, which cannot be gone into by this Court in the present appea-I. Furthcr, during the course of argumcnts. the learned counsel fcr the appellant has spccifica.lly submittcd that the Government was not in possession of the subject Iands and its members are in actual a-nd physical possession over the subject land. In this regard, rvc are of the consitlcrcd view that the learned Single Judge had considerably gone into the various aspccts of the subject land taking into consideration thc material made available on record and also on various judicial pronouncements and decided the matter vide impugned order. Hence, we do not find any illegality or infirmity with the impugned order. Horvever, since it is culled out from the record that thc members of its Association appears to have applied for regularisation of their possession over the subject lar-rd vide G.O.Ms.No.455 dated -)

29.07 .2OO2, it is for the Govcrnment to l.rke decision in the matter and pass appropriate o -(lers in accordance with 1aw. Accordingly, this writ appeal is disposed of leaving it open to rhe appellant to pursue their remedy as available under law."

3. In pursuance to the said direction, pet itioners made applications on 19.03.2024 to the respondent No.2, which were acknowledged on the same day by the respondent N,r.2. Thereafter, no action has been initiated thereon.

4. The learned counsel for the petitioners has drarun the attention of this Court to the G.O.Ms. No.60 dated 31.12.2Ol4 rvherein various G.Os. references have been taken issuing policy gr- rclelines ',vith a direction to the Special Chief Secretary and Chief Commissioner of Land Administration, Telangana, Hyderabad/ Special Olhcer and Competent Authority, Urban Land Ceiling, Hyderabarl and Warangal to take necessary further action in thc matter. Hou l:ver, no action has been taken.

5. The main grievance of the petitioners is that in pr-rrsuance to the direction given b5' the Hon'ble Division Bench thorrgh they made applications on 19.03.2024, the respondent No.2 has not taken any action thereon. l

6. On the other hand, the learned Assistant Government Pleader has placed a copy of the written instructions of the respondent No.2 { wherein it is stated that rvith respect to the subject issue the Government have accorded permission to file Special Leave Petition against the common orders dated 24.01.2024 passed by the Hon'ble Division Bench of this Court in W.A. Nos.SO8 of 2Ol1 and batch ald accordingly SLP with Diary No.ll773 of 2025 on 03.03.2025 against the said common order has bee n filed and the same is subjudice before the Hon'ble Supreme Court and fairly submits that no interim orders were passed by the Hon'blc Suprcme Court and prayed to pass appropriate orders. 7 . In that view of the nattef , rccordirrg the submissions made by the learned counsel on cither side, the respondcnt No.2 is directed to consider the case of the petitior-rers/ applications dated 19 .O3.2024 and if it is found that the pctitioners are otherwise eligible pass appropriate orders in accordance with lau, within a period of Eight (O8) weeks from the date of receipt of a copy of this order.
