THE HONOURABLE SRI JUSTICE N.V.SHRAVAN KT'MAR WRIT PEIITION No.27O75 of 2O2S ORDER: Aggrieved by the action of respondent No.3 - Station House Officer, Telkapally Police Station, Nagarkurnool District, 1n interfering in civil disputes and in calling the petitioner and his brother-in-law to come to the police station for settling the civil issue and compelling to sort out the matter arnong the village elders, the present writ petition is filed. A consequential prayer is sought to direct respondent No.2 - Superintendent of Police, Nagarkurnool District to take action against respondent No.3 and constable for threatening, abusing and illegally detaining the petitioner without following due process of law.

2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing on behalf of respondent Nos. 1 to 3.

The Sub-Inspector of Police placed instructions through a learned Assistant Government Pleader for Home stating that one Mr. Kotte Shivudu has given a complaint on 22.06.2025 to respondent No.3 Station - House Officer, Telkapally Police Station, Nagarkurnool District that his paternal aunt Smt. J.Ramulamma filed suit claiming share in the land to an extent I 2 of Ac.29-2O guntas in Survey Nos.12O, 181, 198 193. The said case is pending. Dr:ring pendency of the suit, she asked the complainart and his three brottrers to pay I(;.40,000/_ for withdrawing the suit. To which, they agreed 1( pay the said amount. It is further submitted that on 22.06.,025 while the complainant along with K.Mallaiah, K.Venkataiar and K.Alivelu were going to her house, her son G.Srinu and Kotte Rarnulu (petitioner herein) obstructed them, abused rr rd beat with hands. Accordingly, the complainalt requested _o take action against G.Srinu and Kotte Ramr-rlu. Based rn the above complaint, the respondent No.3 registered FIR rlo.lOO under Sections 12(2l., 115(2), 352 read with 3(5) of BNS : -t 22.06.2025, in which the petitioner is A2, cousin of the complrinant. Al is the son of J.Ramulamma and A2 is the brothe - in-law of A1. During investigation, the respondent No.3 : ramined the complainant and 4 others, recorded th'eir statemt nts, collected documentar5r evidence, visited the scene of offencr: and prepared crime detail form in the presence of two mediato:.r . As per the statements of witnesses and evidenc e, pima fr :ie offence is established against the petitioner (A2) and A1. It is further submitted that on 21..08.2025, the respondenl No.3 issued notices to Al and ,{2 under Section 35(3) of ltNSS. After completion of investigation, charge sheet has r ren filed on t \ 3 O4.O9.2O25 before the learned I Additional Judicial First Class Magistrate - cum - Special Mobile Court, Nagarkurnool and C.C. number is awaited. It is further submitted that except conduating investigation in the said crime, the respondent No.3 did not interfere in civil disputes and did not try to settle civil lssues. Only for the purpose of investigation and for issuing notice under Section 35(3) of BNSS, the respondent No.3 deputed constable to the house of accused, but not as alleged by the petitioner.

4. Per Contra, learned counsel for the petitioner submits that even after frling the charge sheet, the police are calling the petitioner to the police station.

5. Learned Assistant Government Pleader for Home submits that charge sheet has already been filed and the respondent police would follow due procedure for further course of action.

6. Recording the same, this writ petition is disposed of with a consent directing the respondents to follow due procedure as contemplated under law for further course of action.
