Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents 2 to 6 in not i I i I receiving the application form and release the individual service connection to the petitioner, the Plot No.390, in Survey Nos.11l20 and 11121 , admeasuring S00 Sq. yards, situated at Khanamet (V), Serilingampally (M), Under GHMC, Ranga Reddy District, T.S., bounded by North. MADHUSUDHAN REDDy, SC FOR GREATER HYDERABAD II/IUNICIPAL CORPORATION The Court made the following: ORDER l l THE HON'BLE SRI JUSTICE NAGESH BHEEMAPAI(A WRIT PETITION .26970 0F 2025 ORDER: Petitioners seek a direction to respondents No.2 to 6 to receive the application form and release individual service connection to their property i.e., Plot No.39O, in survey Nos.1Ll20 and 1ll2l, admeasuring 50O square yards, situated at Khanamet (V), Serilingampally (M), under GHMC, Ranga Reddy District, TS., without being influenced by the instructions of the 7th respondent - Greater Hyderabad Municipal Corporation.

2. Heard learned counsel for the petitioners, learned Government Pleader for Enerry on behalf of Respondent No. 1, Sri N. Sreedhar Reddy, learned Standing Counsel for TGSPDCL on behalf of Respondents 2 to 6 and Sri G.Madhusudhan Reddy, learned Standing Counsel for Respondent No.7 - Greater Hyderabad Municipal Corporation.

Ms. Thakur Roopa Singh, learned counsel for petitioners submits that in somewhat similar circumstances, while dealing with Writ Petition No. 20121 of 2025, this Court by order dt.14.O7.2025 directed the respondents authorities therein to release the service connection, subject to the compliance of the statutory requirements by the petitioner therein, and hence, / 2 requested this Court to pass similar order in the present writ Petition also.

4. Recently, the Hon'ble Supreme Court in Rajend.ra Kumar BarJatga a, U.P. Aaas Evam Vikas parishad.t, in the larger public interest, issued directions in addition to the directives issued in Re: Directions in the matter of demotition of strucfitres. Relevant for the purpose of this case are: "(iv) AJI the necessary service connections, such as, Electricity, water supply, sewerage connection, etc., shall be given by the service provider / Board to the buildings only after the production of the completion / occupation certificate. (v) Even after issuance of completion certificate, deviation / violation if any contrary to the planning permission brought to the notice of the authority immediate steps be taken by the said authority concerned, in accordance with law, against the builder: / owner / occupant; and the official, who is responsible for issuance of wrongful completion / occupat.ion certilicate shall be proceeded departmentally forthwith. (vi) No permission / licence to conduct any business / trade must be given by any authorities including local bodies of States /Union Territories in any unauthorised building irrespective of it being residential or commercial building. Any modification to such zonal plan and usage must be taken by strictly following the rules in place land in consideration of the larger public interest and the impact on the environment".

Since the prayer of petitioners is to receive the application form and release individual service connections, this Court without going into merits of the matter, directs the respondents to receive the applications of petitioners and release individual service connections to the subject property, subject to petitioners complying with the directions issued by the Hon'ble Supreme Court in RaJend.ra Kumar Barjatga's case (supra) and the statutory requirements prescribed by the local authorities.

6. The Writ Petition is accordingly, disposed of. No costs.

7. Consequently, miscellaneous applications, pending if any, shall stand closed.
