Judgment
This Criminal Petition, under Section 482 Cr.P.C., is filed to set aside the order, dated 14.09.2012, in Crl.M.P.No.156 of 2012 in Crl.A.No.123 of 2012 on the file of the Sessions Judge, Anantapur.
The petitioner herein is the appellant and he is the owner of the vehicle bearing No.AP-021-W-3783. The petitioner Crl.M.P.No.156 of 2012 in Crl.A.No.123 of 2012 before the Court below for interim custody of the vehicle in question. The learned Sessions Judge, by order, dated 14.09.2012, granted interim custody of the vehicle in question to the petitioner on condition of petitioner furnishing a bank guarantee for Rs.50,000/- and executing a personal bond for Rs.1,00,000/- with two sureties for a like sum to the satisfaction of respondent No.1 herein. The petitioner was also directed to produce the vehicle as and when directed by the Court below during the pendency of the appeal. The present Criminal Petition is filed on the ground that the said conditions are onerous.
Operative part
Having regard to the facts and circumstances of the case, the Criminal Petition is allowed directing the petitioner to furnish a bank guarantee for Rs.25,000/- and execute a personal bond for Rs.50,000/- with one surety for the like sum to the satisfaction of respondent No.1 – Tahsildar, Talupula Mandal, Anantapur District. The other conditions imposed by the Court below remain unaltered.
