JUSTICE TIRUMALA DEVI EADA l.A.Nos .2 and 3 of 2025 in/a nd CRIMINAL PETITIO N No.11738 ol 2025 COMMON ORDER This Criminal Petition is filed by the petitioners/accused Nos l to 5 under Section 528 of BNSS, 2023 seeking to quash the proceedings against them in C.C.No 5516 of 2025 on the file of the XV Additional Chief Metropolitan Magistrate, Hyderabad, registered for lhe alleged offences punishable under Section 85 of the Bharatiya Nyaya Sanhitha, 2023 (for short 'BNS') and Section 3 of the Dowry Prohibition Act, 1961 .
2. lt is submitted by learned counsel appearing for the petitioners/accused Nos.'t to 5 as well as respondent No'2lde facto complainant that during pendency of the present Criminal Petition, the parties have compromised the matter and accordingly, l'A'Nos 2 and 3 of 2025have been filed seeking to compound the offence and to compromise the matter in the above CC respectively'
3. The learned Additional Public Prosecutor has opposed the said compromise Petitions. "\\ 2 EIIt..l Ctly I 1738 20)\ \
4. Perused the affidavits filed by the de facit complainant in l.A.Nos.2 and 3 of 2025 which disclose that Ii rr: has willingly consented for compromise. Since the parties were willing to enter into compromise, they were given a chance to se.l e.the matter by appearing along with their respective counsel befo.r the High Court Legal Services Committee for the State of Telarrr ana vide order dated 11.09.2025 passed by this Court. The Secr: ary, High Court Legal Services Committee shall identify the parti,r; and submit a repo( to that effect

Pursuant lo the above said direction issued lr this Court, the parties along with their respective counsel have appr ared before the High Court Legal Services Committee for the State c,1 l-elangana and the Secretary of the above said Authority identifiec he parties and submitted a report to that effect stating that ttr, parties were identified and they have willfully and without any r;r e:rcion entered into compromise as per the terms of compromise.
6. ln view of the above, l.A Nos.2 and 3 of 2Ci5 are allowed. Consequently, the Criminal Petition is allowed and t o proceedings in C.C.No.5516 of 2025 on the file of the XV,rlditional Chief l\4etropoftan Magistrate, Hyderabad, registere( against the ., Olp lltls :t))5 petitioners/accused Nos.1 to 5, are hereby quashed subject to the petitioners/accused Nos.1 to 5 paying an amount of Rs'5'000/- (Rupees Five Thousand Only) to the Secretary, High Court Legal Services Committee, High Court for the State of Telangana, Hyderabad and Rs.5,0001 (Rupees Five Thousand Only) to the Telangana Bar Association, Hyderabad, within a period of three (03) weeks from today and file proof of the same before the Registry'

It is submitted that Respondent No. 2lodged a ,3mplaint before the Station House Officer, Women Police Station, , lleging that the Petitioners refused to permit her to reside in her nr, t-imonial house and further threatened her with dire consequences she attempted to rejoin thenr, as a result of rthich she has been c rrnpelled to live away from her matrimonial home.
2. It is submitted that thereafter-, the police, baseC c I the complaint lodged by Respondent No. 2, registered a f II1, and after investigation, filed a charge sheet resulting in C.C. l,l ,. 5516 of 2025 dated 05-06-2025 against the DeLitioners herein f r the offences punishable under Section 85 BN!l and Sec 3 of DP Lr .,
3. It is submitted that, with the intervention and r;Lti Iance of elders and well-\,vishers, both parties have amicably rrr: tlved all their disputes and differences without any coercion, pr€s ;ure, or undue influence. In order to avoid any future misunJ:rstandings or conflicts, the parties have settleo the matter amica I / out of Court. In view of the said settlement, Respondent No. 2 tls voluntarily come forward to withdraw the complaint and has ; l: c executed an Affidavit expressing her willingness to withdraw the I ove said case. It is submitted that, as per the terms of setttement, Respondent No. 2 has agreed to resume and continue to live with her husband (Accused No. 1) in a cordial and harmonious manner, and has further undertaken not to initiate or pursue any criminal proceedings against the Petitioners or their fanrily members in relation to the said matrimonial dispute.
5. it is respectfully submitted that, since the matter has been amicably settled out of Coud-, Respondent No.2 is ready and willing to withdraw the case again:;t the Petitioners. In view of the above circumstances, this Hon'ble Court may be pleased to quash the proceedings in C.C. No. 55lC of 2025, dated 05 0.S-2025, on the file of the learned XV Addlfional Chief lYetropolitan lt4agistrate, Hyderabad. in the interest of justice; otherwise, the Petitioners and their family members will Lre put to great hardship and irreparable loss.
