Having regard to the r.ival colltentions and the material on record, this Court finds that the petitioner rvas supplied with CMR paddy and as per the agreernent. thc peritioner is bound to supply the custom rnilled rice. IJowever.. the petitioner, along with other. rice millers, rnade a r-cpresc.ntatiotr beflor.e r.espondent No.4 statin-q that some of the paddy was danraged duc to heavy rains and the \ TMDI wp _26A?1 2025 3 responclent authoritics are required to consider the representatton ar-rd therealtcr determine the actual shortfalt' Theretbre' respondent No.4 is directed to consider the explanation of the petitioner with regard to the shortfall fbr Rabi 2022-23 and take a decision thereon aliel giving the petitioner a reasonable opportunity of hearing and arrivc at the sl.rortl'all Respondent No 4 shall take a decision ivithin a pcriod ol loLrr (0ul) weeks from the date of receipt of a copr o1'thi: ot-clcr ertd thercatter' the pctitioner shall makc good the loss as per the said dctermination' Faiting which' the respondents are at libefly to proceed iu accordance with law' As regards thc sliortlall tbr Kharif and Rahi 2024-25'this 5. court observes t-hat sincc rhe period for supply of,custom milled rice has not yeL tapsed, the respondents cannot take any coerclve stcps agairlst tl'rc pctitionel at [his sl"age' ]-lowever'' since there has been shortl-all in CNtR paddy in the earlier seasons' the petitioner is pelmitted to carry oul custom milling of paddy under the supervisiou of the coucerncd officials in order to see that the agreed quantity of CMR rice is supptied within prescribed period' If there is any shorlthtt in the supply of CMR rice thereafter' the I 4 TMD] wp_26821 2025 Yil .l respondents are free to take action in accordance with law and till such time no coercive steps shall be takcn against tirc pctitioner. 6' Accordingly, the p.occccring clarcd 2g.0g.1015 taking rhe stock of the petitioner into cusrodr, is set aside. fhe respondent authorities are permitted to procecd in accordancc with the above directions.
