Aggrieved by the action of respondent No.3 in not receiving, registering and releasing the SaIe Deeds dated 13.08.2025 prcsented by the petitioner .in respect of open place admeasuring 249.50 Square yards or 208.61 Square meters in Sy.No.79/B and ACC House No.15-3- t 761514/ ll Al l, admeasuring 249.50 Square yards or

208.61 Square meters in Sy.No.79/B, situated at Rekurthy Village, Kothapally Mandal, Karimnagar District, the petitioner filed the present writ petition.

3. The Assistant Government Pleader for Stamps and Registration has stated that the respondents will follow the 2 procedure and release the documents or thev will pass orders as per Section 71 of the Registratiorr Act, 1908 (for short, the Act, 1908J.

Section 71 of the Act, 19O8, reads as foliows Reasons for refusal to register to be recorccd.- (1) Every Sub-Registrar refusing to rcgistcr a document, except on the ground that thr property to rvhich it rela[es is not situated u,ithin his sub- district shall make an ordcr of rcfusal anc rccorded his; reasons for such order in his Book l'1o.2, and endorse the words "registration refused" on the document; and, on application made by aly person exr:cuting or claiming under the docume nL. shail, wirhout payment and unnecessary delay, give him a c:opy of the reasons so recorded. \ (2) No registering officer shall accept for registration a rf ocument so endorsed un less ancl un il , under thr: provisrons hereinafter contained, the riocument is rlirected to be registcrcd.

In view of the aforesaid submissions c()upled with the provision under Section 7l of the Act, 1908, this writ petition is disposed of directing the Registering Authority to receive, register and release the subject documents that 3 may be prcsented by the petitioner in respect of the subject property, subject to the petitioner complying with the provisions of the Act, 1908 as well as the Indial Stamp Act,

1899. It will be open to the Registering Authority to refuse the documents presented before him, if he has arry objection, by duly assigning reasons in support of such decision and communicate the said decision to the petitioner. It is made clear that this Court has not expressed any opinion on merits of the case as to the entitlement of the petitioner to get the subject documents registered. There shall be no order as to costs.
