Brief facts in this n,rit petition as staterl are that the petitioner claims to be the owner and possessor of lancl atlmeasuring 1200 So.yards in Plot Nos.54C, 541.,544,545, 516 anJ 547 in Sy No.796lA. Ward No.1, Block No.5, situated at Mahendra Hills, Nalgoncla To'ain and District, having acquired the same through registered agreement of Salc-cum-General Power of Attcrney bearing document No.6597 ot 2022 clatecl 13.04.2022. Thereaftcr, the petitioner was in peaceful posscssion of the subjcct propcrty. Thc case of thc petitioner is that respondent No.6 is en-gagccl in roal cstatc business and had purchased ). -- the plot No.542 ancl 543 in Sy.No.796/ A. The respondent No.6 had approached the petitioner to sell his plots on cheaper ratc, I'ow'ever, whcn the petitioner denieC to sell his plots, rcspondent No.6 hatche, I a plan to extort petitioncr's plot:;. It is f ,rrthcl statcd that on 07.09.2025 at about 7.00 Pm, the petitioner along with other'havc illegally demolished the compound wall with JCB and caused loss to an arnount of Rs.90,000/-. At this stage, learned counsel for the petition.'r su bmits that respondent No.5 is calling the petitioner and threatcning hin, to settle disputc with respondent No.6 anci pray this Court to direct the respo rclcnt ,tuthorities ,t ,/ J not to interfere into the civil dispute between the petitioner and respondent No.6

Recording thc submissions made by learnecl counsel appearing on either side and without expressing any opinion on the merits of the case, this writ petition is disposed of directing the respondent authorities to follow due procedure as contemplated under law before initiating any action on petitioner. it is made clear that thc petitioner shall co-operate with the pending investigation in crime No.169 of 2025 dated 02.09.2025.
