2. Heard Sri M. Sudarshan, leamed counsel for the petitioner and Srnt. NVR. Rajyalaksluni, learned Standing Counsel for the Central Govemment. Perused the record. ,) Dcspite service of notice on respondent No.3, none appeared on behalf ol'him

4. Lcarned counsel for the petitioner submits that merely thc petitioner arrayed as accused in a crirninal case cannot be a ground lor denial of rcnerval ol- passport. He relies on the judgment of this Courl in \V.I'].No.35056 of 2023, dated,02.01 .2024.

5. Lcarned Standing Counsel submits that there is a pending criminal case against the petitioner and theretbre refusal to renerv the petitioner,s passporl as per Rules cannot be said to be illegal. I I

This Cou( having considered the respective submissions rnade by leamed counsel ,for the parties and considering the judgment passed by this Courl in W.P.No.35056 of 2023,dated 02.01.2024, directs respondenr No.2 i to consider the online Application filed by the petitioner herein seeking renewal of passport on the following conditions: i) The petitioner herein shall submit an undertakin,y along with an affidavit in C.C.No.1535 of 2024, pending on the file of V Additional Metropolrtan hrlagistrate-cum-lV Additional Junior Civi Judge at L.B.Nagar, Ranga Reddy Distflct, stating that he shatl rot leave lndia during pendency of the said C.C., without permissron of tha trial Court and that he shall cooperate with trial Court in cln:luding the proceedings in the said C.C.; ii) On filing such an undertaking as well as atf id. vit, the trial Court shall issue a certified copy of the same within trvr, (2) weeks therefrom; iri) The petitioner herein shall submit an applicatro'r rrfresh along wrth certified copy of this order as well as the aforesa d undertaking before the Passport Officer / Authority concerned for renewal of passpo rt; iv) On filing such an application, the Passport Off ce r / Authority shall consider the same afresh in the light of the observalto.'ts made by this Court herein as well as the contents of the undertaking ,yiven by the petitioner for renewal of passport, in accordance with la,,v, &ithtn three (03) weeks from the date of said application, v) Respondent No.2 shall consrder Rule '12 of tl e Passport Rules. 1967 r"vhile considering the aforesaid applicatron s tbnritted by the petitioner vi) On issuance of the Passport, the petitione' lrerein shall deposit the same before the tnal Court in C C.No.1535 of :2024 pending on the file of IV Additional Metropolitan Magistrate-cum -l\ / Additiona!
