The petitioner approached the Court seeking prayer as under: "...to issue a Writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents in not renewing the petitioner renewal application 15.09.2022 to run Residential Hostel issuing fresh tender notification dt.07.09.2022 through News paper calling application without paying the pending due amount of Rs.16,10,000/- to the petitioner firm is illegal, arbitrary and in violation of principles of natural justice and consequenUy direct the respondent to consider and renewal the application 2 of the petitioner dt.15.09.2022 as per dt.O7.09.2022 through News Paper and pass,..". 3. The case of the petitioner, in brief, is that the petitioner society is a registered society, established for upliftment of the development of poor children, downtrodden, orphan. The petitioner made representation before the 4th respondent for renewal of permission to run the Urban Residential Hostel. It is further case of the petitioner that pending the renewar application of the petitioner, the respondents issued notification on i5.09.2022 calling for application for running of orphans, street begging boys and girls at Hyderabad Urban Residentiar Hostel. The petitioner society got heavy loss during the acidemic year 2020-2021 clue to non-payment of salaries to the teaching and non-teaching staff and the petitioner society sought further extension of renewal of urban Residential Hostel permission. Aggrieved by the action of the respondents in not renewing the petitioner's renewal application dated 15.09.2022 to run Residential Hostel and issuing fresh tender notification dated 07.09.2022 by respondents without paying the pending due amount of Rs.16,10,000/- to the petitioner society, the I i , i i j j ; i 3 s2il2i wp rarzs petitioner approached the court by filing the present writ petition. Learnea Senior Oes submissions:- i) Though the petitioner had filed renewal application on 15.09.2022 to run Residential Hostel no orders had been passed on the said application of the petitioner dated 15.09. 2022 as on ii) In spite of a detailed representation dated 01.11.202L addressed to the 4th respondent herein for release of salary bills pertaining to Urban Residential Hostel at Kotla Alijha, charminar in Hyderabad for the year 2oL7-2otg, no orders had been passed on the said representation of the petitioner as on date. Hence, therefore, the writ petition could be disposed.of directing the concerned respondents to pass appropriate orders on petitioner's application dated 15.09.2022 and the representation of the petitioner dated 01.11.2o2t addressed to the 4th respondent herein. 4 SN. Takinq into consideration : (a) The facts and circumstances of the case, (b) The submissions made by the learned counsel appearing on behalf of the petitioner and the learned Standing Counsel appearing on behalf of respondent No.4, (c) The application of the petitioner dated L5.O9.2O22 seeking renewal to run Urban Residential Hostel at Kotla Alijha, Chariminar in Hyderabad, ' (d) The representation of the petitioner dated O1.1L.}OZL addressed to the 4th respondent herein which had been acknowledged by the 4th respondent on
01.1L.2O2L itself, but however no action had been taken as on date, The writ petition is disposed of directing the 4th respondent to pass appropriate orders on the renewal application of the petitioner, dated 05.Og.2022, in accordance to law to run Residential Hostel if not already 6 SN, J wP:)6t79_2022 passed, within a period of one (1) week from the date of receipt of a copy of the order. The 4th respondent is directed to consider the petitioner's representation dated O1.1L.2O2t addressed to the 4th respondent seeking release of due salary for the bills pertaining to the staff of Urban Residential Hostel at Kotla AIijha, Charminar at Hyderabad for the year 2OL7-2O18, and pass appropriate orders on the said representation dated O1.11.2O2t in accordance to law, within a period of one (1) week from the date of receipt of a copy of the order and duly communicate the decision to the petitioner.
