Th t h averments made in h tn su o of h I n VI ief ars per the the petitaoner n S lrnder: i) The petitioner joined Respondent No.5 College in the academic year 2OL6-2017 to pursue the Bacl-rr:lrrr of Dental Surgery (BDS) course on 24.09.2016. ii) Although the petitioner aspired to beco re arr MBBS doctor, she could not secure a medic.rl seat and consequently suffered from depression and was under psychiatric treatment during the period betw€en 2016 and I SN.J w.P.No.26742 0f 2025

The petitioner was unable to clear her first-year examinations until August 2022 and completed her 2nd, 3'd, and 4th years without backlog after complete recovery from depression and commenced her rotatory internship only in )uly 2025. iii) While the internship was in progress, Respondent No.5 issued a letter dated 30.07.2025 discharging the petitioner from the course on the ground that, as per DCI norms, the petitioner failed to complete the BDS course within the prescribed nine-year period, including internship and the petitioner was required to complete her internship by

25.O9.2025 and, therefore, the petitioner was not permitted to continue in the rotatory internship programme from

26.O9.2025 onwards. Aggrieved by the impugned letter dated 30.07.2025, the petitioner filed the present writ petition.

Sirtce th,:n I have becn under the observation and medir:ation of the Doctor till the year, 2022 and in between I tried to make atternpts for writing the exams but cluld -ot concentrate in the said exams and did not clear t1e first year sub;e:cts till November, 2O2l and by the rn,:nth of Auqust, 2{122 I have cleared all the subject cf tre fi'si year. By the end of year, 2021 t have recove-ed from the depression after taking the medication ulder the supervision of the Psychiatric treatment." DISCUSSION AND CONCLUSTON:

5. Learned counsel appearing on behalf of thr: ps1111ensr- submits that the petitioner had serious healtlr issues and was suffering from depression and psychiatr c problems. The petitioner had been under the observation and medication of a doctor from the yeat 20L7, until the year

2022. Upon diagnosis, the doctor had rr:c:omrnended Cognitive Behaviour Therapy on 19.02.2017. Due to the petitioner's health reasons, the petitioner could not clear the first-year subjects until November 2021 and had cleared them only in August 2022. fo the petitioner's shock, the i I] ! i w 7 sN,J W.P.No.26742 of 2025 petitioner received the impugned letter dated 30.07.2025 issued by the respondent No.5 college discharging the petitioner from the course on the ground that, as per the DCA norms, the petitioner had failed to complete the BDS course within a period of nine years.

Learned counsel appearing on behalf of respondent No.3 submits that the relief sought by the petitioner i.e., permitting the petitioner to complete the Rotatory Internship Programme up to 11.07.2026 at respondent No.5 college cannot be granted in view of the simpre fact that the petitioner had not submitted any representation to respondent No.3 as on date putting forth the grievance of the petitioner as put forth by the petitioner in the present writ petition. Hence, no mandamus can be issued against respondent No.3, and the petitioner cannot complain inaction on the part of the respondents in considering petitioner's grievance.
