5. The appellants have rtrspecl to dirccri66 16 p21 -[ challenged the impugr ed judgment wrth 7otl6 on the remainirr ? amount i.e., after (r, : batim reproducecl) 3 RY,J .MSA 26 .2025 deducting the said amount within two months from the date of the judgment.

6. Le;rrned counsel lbr the appellants submitted that such a clirection r't ould c'zrttse pre-judice to their rights u'hen the matter is considered afrcsh bv the Municipal Authoritics lor re-assessment of \ \ Property Tax.

Learned standing counsel for the respondents-GHMC conceded that no such diri'ction lor clc'positing of thc amount is made at the time of disposal of the main appeal and that the order of such a nature is passed at the time of moving the Municipal Appeai along rvith the lnterlocutory Application lor grant of star'.

Having regard to the concerns rarsed by the appellants about their rights being prejudiced during re-assessment, since the matters have been remanded back to the Municipal Authorities for fresh re assessment, the directron ro deposit 7 Otl'o ol amount of impugned order is liable to be set aside.

9. The Civil Miscellaneous Second Appeal is Allowed.
