This writ petition has been filed sccking the following prayer:- "...direction against tle Respondent No.4 is threatening u.tith false criminal charges utith tte instigation of respondenl 1[os.5 to lE as this repeated tnrassment is causing seuere menta! agony and disrupting petitioners familg ltfe and liuelihaod and the acts of the resporudent Nos.4 to 18 is nothing but arbitral, illegal, null and uoid and uiolation of pinciples of natural justice and also uiolation of Articles 14, 79 and 21 of the Constilution of the India and consequently direct the responderut No.4 not to tLveaten the petitioner bg calling him to tle police station on regular basis. ,. "

Brief facts as stated in this writ petition are that petitioner lodged a complaint against responcicnt No.4 who has influence of respondent Nos.S to 18 and that rcspondent No.4 is harassing the petitioner and petitioner's brothers for civil recovery arnount. It is submitted that petitioner has invested huge money about Rs.4O,0O,OOO/- with one Bala Krishna, who lured lhe plti!94er Bs 1€-? i I 2 to invest amounts for getting interest. Believing the same, petitioner along with his friends and relatives invested with the said Bala Krishna. Later on in the month of July, 2024, Bala Krishna absconded without paying a single pie to the petitioner ald has not attended to the ca-lls of the petitioner. Later on petitioner's friends instigated one M.Narayanarnma w/o. Krishna Reddy who approached respondent No.4 and pressurized respondent No.4 for their amounts. Accordingly, respondent No.4 lodged FIR in FIR No.73l2024 against the petitioner. The petitioner have repeatedly approached respondent No.4 for lodging a case against Bala Krishna and not willing to investigate the case and no charge sheet is filed even after 9 months. Questioning the sarne, the present writ petition is filed

Learned Assistant Government Pleader for Home appearing for respondent Nos.l to 4 placed on record instructions issued by Sub-Divisional Police Officer, Wanaparthy wherein it is stated that on 3O.O9.2O24 respondent No.4 received a complaint from Smt.Murakonda Narayanarnma alleging that petitioner herein used to visit her house and ask money and used to pay interest to the same. However, petitioner did not pay back the same. Basing on the above complaint, respondent No.4 registered crime again st the petitioner herein in FIR No.Z3/2024 under Sections I 3 42O, 406,506, 509 read with Section 34 IPC dated 3O.O9.2O24. During the investigation, respondent No.4 examined the complainant and other witnesses and recorded their statements and collected evidence. As per the investigation, prima facie offence is established against the petitioner, as such respondent No.4 issued notice under Section 35(3) of BNSS dated Ol .1O.2O24 to petitioner herein directing them to appear before I respondent No.4 within 3 days and produce the relevant documents/material required for the purpose of investigation. The petitioner did not comply with the said notice till date and that petitioner instead of cooperating with the investigation, filed the present writ petition. It is further submitted that due to non- cooperation of the petitioner herein, investigation 1S pending since more than 1O months.

5. After arguing the matter at length, learned counsel for the petitioner submits that petitioner would cooperate with the enqurry.

Recording the submissions made by the learned counsel appearing on either sides, this writ petition is disposed of with a direction to respondent authorities to follow due procedure as I 4 contemplated under law for further course of action. Needless to state that petitioner shall cooperate with the enquiry. Miscellaneous applications, if any pending, shall stand closed. No order as to costs. //TRUE COPY// SD/.
