With their consent, this writ petition is being taken up for disposal at the aclmission stage itself

This writ petition is filed by the petitioner being aggrieved by the action of the respondents in not registering the F.I,R in pursuant to the complaint of the petitioner dated 21..08.2A25 and 29.08.2025 a6,,ainst the unofficial respondent Nos:5 to 8 though they have committed cognizable offences as illegal, arbitrary, unconstitutional, violative of principlcs of natural justice and consequently, t9 direct the official respontlcnt to register the F.I.R against the un-official respondents duly effecting the arrest of the accused and conduct investigation by follorvinii r{ue procedure of [aw.

The brief facts of the case are tna-t the petitioner claims to Lrc thc absolute owner and possessor of the land in Sy.No.3l2/RU /1 to arr t:rtt'rrt oi Ac.1-15 guntas situated at Polkampalli Village, Ibrahimpatnam N'l.rnclal, Ranga Reddy District (hereinafter referred as'subject property'). [t is further submitted tl'rat her son's marriage was performed with unofficial respontlent No.5, respondent Nos.6 and.7 are trcr parents and respondent No.tl is her brother and during Bonalu festival on 18.08.2025, her daughter-in-law 2 deliberately pickeci up quarrel with her and called her parents and brother to 'her house and they abused her in utter filthy language, kicked, twisted the fingers, dragged saree and beat her mercilessly. It is further subrnitted that the unofficial respondents with support of their relatives forcecl her tb register her agricultural property in favour of her grand son and accordingly, a slot was booked by unofficial respondents ancl she was taken to registration office anrl her signatures were forcibty obtaineci on the documents. However, at the time of registration the revenue authorities insisted to produ.ce the originat Pattedar pass book since she did not have said pass book she escaped from the clutches of unofficial respondents. It is further submitted that during mid tight, the unofficial respondents called her over phone, threatened with dire consequences to kill, if she rlo not come back to the registration o icer, as ,: such she to went to tl're relative house for sheltcr and got tr€ated in the hospital on 21.08.2025 ancl later approached 4tl respondent to rnake complaint but, .ltlt responderrt rciusec{ to rcceive' her complaint, as such she sent her complaint dated 21.0t1.2025 through post, even then 4s respondent neither registered the complaint nor resorted to conduct investigation. It is further submitted that she matle representation/compliant to 2"d and 3.d respondents on29.08.2025 and thc responclent Nos.2 and 3 being higher authorities to 4t respondent did not consider or direct the 4th responderrt to conduct investigation anc{ register F.l.R till date. Learned Assistant Government Pleader appearing for Home has placed a copy of written instructions submitted by Sub-Inspector of Police, Ibrahimpatnam Police Statiory Rachakonda Commissionerate wherein it is submitted that petitioner's husband rnmelySri G. Swaryy lodged a complaint with 4ft respondent on 25.08.2025 stating that the complainant's second son by name Sri Gunukula Rajugot nrarried with Smt. Gunukula Ashwini in the presence of elders and they are blessed with one boy child by name Master Gunukula Yashwanth. It is further submitted that both the wife and lrusband quarrelled and the elders discussed that some land in Sy,No.302, Jajonibaavi to be registered on the name of complainant's gTand son and on the next day on 20.08.2025, the complainant woke up and found that his wife and his son \ were missing. Later the complainant searched nearby places, their relatives houses about his wife and son but in vain and found missing. [t is further submitted that basing on the said complaint case has been registerecl in Crime No.489 of 2025clatec{ 25.08.2025and investigation has been taken up. During the course of investigation, investigating officer visited the scene of offence, examined and recorded the detailed statement of complainant, issued [.ook Out Circular, obtained CDR, circulated the Radio Message to all Station House Officers of Telangana however, sincere efforts are being continuecl to trace out the missing persons and after finalization of investigation, appropriate report will be filect before the competent court. It is frrrther subrnitted that the representation of the petitioner dated 27.08.2025which r,r,as alleged to have been sent through post was not received on 29.08.2025 and as , t 4 and when the petitioner approaches the police station necessary action will be a) taken as per law. Along with the copy of instructions, copy of F.I.R in Crime No.515 of 2025 dated 08.09.2025 was annexed.
5. Recording the same, this writ petition is disposed of with consent directing the reSpr:ndent authorities to follow due procedure as contemplated under law subsequent to fiting of the F.l.R.
