VIJAYSEN REDDY WRIT PETITION No.26540 OF2025 ORDER:(ORAL) This writ petition is filed by the petitioner seeking to declare the action of respondents No.2 to 4 in not allotting house number to her property bearing H.No.3-124, Plot No.l24 in Survey No 103, situated at Vivekanand Nagar Colony, Peerjadiguda, Medchal-Malkaj giri District' for the purpose of payment of property tax, as being illegal, arbitrary and unconstitutional

2. Heard Ms. Preety Swarnalatha, learned counsel for the petitioner; Mr. Putta Krishna Reddy, leamed Standing Counsel for Peerjadiguda Municipality, appearing for respondents No'2 to 4; and perused the material on record.

3.ItisstatedthatoneMs.CherkuGandamma,isalandlesspoor person and the Govemment allotted her house site patta vide ordet No.B129071/1997 dated ni1.07.1999 vide layout residence letter No. 1 2 148/I{P 21w97 dated o7 .o2.lgg8. Ms. cherku Gandamma applied for building permission in the Gram Panchayat, Medipally and permission was granted on 27 .07 .2006 for an extent of 60 square yards in 2 Plot No.l24 in Survey No.l03, Medipalty Village, Ghatkesar Mandal, Ranga Reddy District. That due to tlnancial problems, Ms. Cherku Gandamma sold the subject property to the petitioner under registered sale deed dated 20.07 .2006 for a valid sale consideration of Rs. 1,45,000/- (Rupees one lakh forty five thousand only). The petitioner paid the entire sale consideration and the agreement of sale was notarized. The petitioner, in fact, paid the house tax to the Gram panchayat from 2006 to 2021. The petitioner obtained electricity service connec tion vide SC' No.163206845 and uSC. No.10959790r and also rvater connection to the subject property and in that regard, she had been paying the charges regularly. It is further stated that when the Gram panchayat, Medipally merged with Peerzadiguda Municipality, the petitioner , approached the respondent authorities lor payment of property tax in respect of the subject property, however, she came to know that the house number of the subject propefty was not found in the municipal records. As such, the petitioner submitted representarions dated 16.06.2025 and,

16.07.2025 by enclosing title documenrs including Gram panchayat permission, electricity bills and other relevant documents and requested the respondent authorities to allot house number to the subject property. Subsequently, respondent No.2 issued Memo No.r934r2oz5rc1/p.Mc I I l I l l i I I l dated 31.01 .2025 stating that door number cannot be allotted due to non-submission of valid ownership documents' As such' the petitioner was constrained to approach this Court'

4. Learned Standing Counsel for respondents No'2 to 4 submitted that the petitioner does not have valid title to the subject property and cannot seek for allotment of house number' \ \

5. Learned counse[ for the petitioner relied on the order passed by this Court in W.P. No.13772 of 2025 dated l3'04'2025 wherein in similar circumstances, the respondent authorities were directed to consider the representation of the petitioner therein dated 16'12'2024 for allotting house number to the property and requested this Court that the same t order may be Passed- In the circumstances, without entering into the merits of the case' 6. this writ petition is disposed of directing the respondent authorities to consider the representations of the petitioner dated 16'06'2024 ar:d 16.07.2025 for allotting house number to her property bearing H'No'3- 124, Plot No.l24 in Survey No'103, situated at Vivekanand Nagar Colony, Peerjadiguda, Medchal-Malkajgiri District' by giving -,,l:3- ': '5.1ir - 4 t I oppoffunity of hearing to the petitioner, and pass appropriate orders in accordance with law, within a period of four (4) weeks from the date of receipt ofa copy of this order.
