Not satished with the conrpensation awarded by the Land Acquisition Officer, the appellants have sought reference under Secticn 1g of the Land Acquisition Act [or enhancemcnL ol compensation and the references r,ve re numbered as O.p.Nos.3g, 4g and 57 of 200g. The reference Co rrt u,as pleased to cnhance the r:ompensation to Rs.146/- per square yard for all the lands acquirec.

Learnec counscl for the appellants had further contended that in respect of other lands covered under the very same acquisition, tt.c reference Court has enhance d the ,.:ompensation to 2 AKSJ & ETD,J LAAS 1072 & batch Rs.354/- per square yard in O.P.Nos.2g, 30 and 3l of 2Ol2 uide common order dated 03.09.2015 and aggrieved by the same, the respondents therein have preferred 4Ppeals before this Court i.e. LAAS Nos.353, 354 and 355 of 2016, and the Division Bench of this Court was pleased to dismiss the appeals preferred by the respondents therein uide common judgment daLed 16.03.2022, whereby the enhancement of comperisation made by the reference Court to Rs.354/- per square yard wqs conhrmed.

Learned counsel for the appeflants had further contended that, admittedly, in the instant casg, the lands of the appellants were also acquired for the very same purpose pursuant to the very same notiflcation, but the reference Court has enhanced the compensation only to Rs. 146/- p". iq,.,u.. yard, and as such the appellants have preferred the presedt appeals seeking to enhance the compensation to Rs.250/- per sqpare yard.

Learned counsel for the appQllants had further contended that the appellants have filed amen$ment applications in all these three appeals seeking enhancement of compensation from Rs.250/- to Rs.354/- per square yard. Learned counsel further contended that, in case, the compenLation is enhanced to Rs.354/- per square yard, the appellants wQuld pay the defrcit Court fee' Therefore, foltowing the order, datgd 16.03.2022, passed by the 3 AKSI & ETD,J I-AAS 1072 & batch Division Bent:h of this Court in LAAS Nos.353, 3S4 and 355 of 20 16, the pre,;ent appeals may be disposed of.

5. Learnec Government Pleader did not dispute the said facts

6. This Cor-rrt, having considered the submissior-rs made by the learned counsel for the parties, is of the consider,:d view that the reference Cotrrt erred in not enhancing the compensation to \ \ Rs.354/- per s;quare yard, more so, when the same refercnce Court has cnhanced the compensation to Rs.354/- per square yard in I I respect of the lands covered in O.P.Nos.29, 30 and 3l of 2012 uid.e common order dated 03.09.2015. Therefore, the reference Court ought to have cnhanced the compensation to Rs.3r4/- per square yard in respecl of the subject lands also. Since the reference Court has enhanced the compensation to Rs.354/- per sqLlare yard in respect of the lands covered under the very same acquisition subsequent to filing of the subject O.ps., the pres,:nt appeals are liable to be d isposed of by enhancing the comltensation from Rs.146/- per square yard, as awarded by the relcrence Court, to that of Rs.354/- per square yard.

7. Accordinl4ly, the present appeals are disposcd of by enhancing the compensation from Rs.146/- per :jquare yard to Rs.354/- per squarc yard, following the common orcler dated
