Ms. Thakur Roopa Singh, learned counsel for pctitioncrs submitsthatinsimilarcircumstances,whiledealingwithwrit PetitionNo.2Ol2lof2025,thisCourtbyorderdt.|4.o7.2o25 directed the respondents authorities therein to release the service connection, subject to the compliance of the statutory requirements by the petitioner therein, and hence' requested this Court to pass similar order in this Writ Petition also' \ ,/1 2 \.1 -

4. Recently, the Hon'ble Supreme Court in Rolendra Kumar Barjatga a. U.P. Aua.s Euam Vikrrs Parishad 1 , ir.L the larger public interest, issued directions in addition to the directives issued in Re: Directions in the matter of demotition o.f structures. Relevant for the purpose of this case are: "(i") (v) ("i) A11 the necessary service connections, such as, Electricity, water supply, sewerage corrnection, etc., shall be given by the service pr:vicler / Board to the buildings oniy after the production of the completion / occupation certificar_e. Even after issuance of completion certificate, deviation / violation if any contrary to the plalning permission brought to the rrotice of the authority immediate steps be taken brz the sald authoriW concerned, in accordance with law, against the builder / owner / o<:cupant; and the ofhciai, who is responsible for issuance of wrongful completion / occupation c<:rtificate shall be proceeded departmentally forthwittr. No permission / licence to cohdtrct any trade must be given by any business I authorities including local bodies ol Srates /Union Territories in any unauthorised building irrespective of it being reside ntial or commercial building. (vii) The development must be in conformity with the zonal plan land usage. Any modification to such zonal plan and usage must be trtken by strictly following the rules in place land in consideration of the larger public interest and the impact on the environment".

Since the prayer of petitroners in this writ petirion is to receive their :rpplication forms and release ind vid ual service r;onr-rections, this Court, without going into the merits of the ' 2024 SCC Online sc 3767 S '._:j:'--'-l''*-.. ------- :.-i-r-1qB'*=?tl 7 3 matter, directs the respondents to receive the applications of pcLitioners and release individual service connectiol-ls to the abovementioned propert5r of the pctitioncrs, subject to the petitioners complying with the directions issued by the Hon'ble Supreme Court in Rajendra Kumar Barjatga's case (supra) and the statutory requirements prescribed by the local authorities.
