CRIMINAL PETITION NO.10386 OF 2009
ORDER:
Though this petition is filed seeking quashing of Crime No.289 of 2009 of Vijayawada I Town police station, relating to offences punishable under Section 34 (a) of the Andhra Pradesh Excise Act, 1968, and Section 135-C of the Representation of People Act, 1951, the only point urged by the petitioner’s counsel before this Court is that the petitioner’s Maruthi car was seized by the police in this offence and that it is lying un-attended and that when he applied for return of the car, he is being driven from pillar to post asking him to approach the Deputy Commissioner of Excise and the Collector, as the offences involved were under the above two enactments. In such a situation, the petitioner is at liberty to move the appropriate Court or authority for necessary reliefs relating to release of his car or interim custody of his car. I do not find any valid and legal reasons to quash F.I.R. in this case.
