HONOURABLE SRI JUSTICE ASHUTOSH MOHUNTA WRIT PETITION Nos. 15649 of 2009 & 10541 of 2012 COMMON ORDER: These two Writ Petitions can be disposed of by this common order. The petitioners have prayed that a direction be issued to the second respondent to consider and dispose of the appeal filed by them, which is pending adjudication since 2007. The learned Counsel for the petitioners submitted that more than five years have elapsed in filing the appeal, however the same has not been disposed of yet. After hearing the learned Counsel on either side and without going into the merits of the subject matter, the second respondent is directed to consider and dispose of the appeal said to have been filed by the petitioners, if not already decided, on merits and in accordance with law, expeditiously, preferably within a period of three months from the date of receipt of a certified copy of this order. It is further directed that before deciding the appeal, notice shall be issued to all the concerned parties afresh. The Writ Petitions are disposed of. The miscellaneous petitions filed therein shall stand disposed of as infructuous in consequence. There shall be no order as to costs. -------------------------------------- JUSTICE ASHUTOSH MOHUNTA Dated 25th June, 2012 Msnro
