No. 489 of 2008 and Cross Obiections Judgment: iPer Hon'ble Sn Juslice ASHUT)SH ^,|)HUNTA) The State of Andhra Pradesh has filed this appeat impugning the order dated 07.1 1 .2006 passed by the Senior Civil Judge, Asifabad, in O.P.No.70.of 2000, whereby compensation @ Rs.20,0001 per acre was awarded for the land and Rs.1,000^ for houses over and above the Land Acquisition Officer awarded.

The State of Andhra Pradesh vide notification dated 21.03.1996 issued under Section 4(1) of the Land Acquisition Act (for short 'the Act') intended to acquire nearly 300 acres in this appeal and 155 houses in Mandrumada village, Adilabad District for the purpose of submergence of Vattivagu project. The total acquisition under the aforesaid project was approximately 600 acres. Declaration under Section 6 of the Act was issued subsequently. The Land Acquisition Ofticer, vide his award dated 23.08.1998, fixed the market value of the land at Rs.4,6001 per acre and awarded Rs.12,38,162/- for 155 houses which had already been acquired.

Being aggrieved by the award of the Land Acquisition Officer, the land owners filed applications under Section 1B of the Act claiming Rs.40,0001 per acre as compensation and three times the amount as awarded by the Land Acquisition Officer with regard to the houses. In evidence, the claimants placed reliance on Exs.B.1 7 and 8.18, which are the crop yielding certificate issued by the lVlandal Agricultural Officer, Thiryanr and price list issued by the Secretary, AMC, Asifabad, respectively. By taking the aforesaid documents, they also relied on Ex.B.19, which is a sale deed dated 09.07.1982 whereby one acre of land situated in Lingiguda village was sold for Rs.9.9001 per acre. Apart from the above, Exs.B.2O and 8.21, which are valuation of structures of Mandrumeda village issued by R.W.11 and valuation certificate of Etevaiguda, Mandrumeda, Gottiguda were also relied on.

4. The relerence court re.iected Ex.B..l g, which is the sale deed dated 09.07.1982 as the same related to another village and the same was void sale being situated in a notified tribal village. However, the reference court placed reliance on Ex.B.17, which is the crop yielding certificate and the price list Ex.B.18 and determined the valuation of the land at Rs.20,000/- per acre. As far as the struclures are concerned. the reterence court awarded a sum of Rs.1,0001 per house over and above what was awarded by the Land Acquisition Officer.

5. Being aggrieved by the a{oresaid judgment, the State of Andhra Pradesh has riled this appeal, primarily with regard to price of the land, on the other hand, the claimants have also filed cross objections with regard to the houses.

6. A perusal of the impugned iudgment shows that l\rlandrumeda village is a n,ttified tribal village where no sale instances took place. Thus, the onl'y way out for the reference court to determine the market price of the land acquired was to rely on the crop yielding certificate issued by the I\,4andal Agricultural Officer, Thiryani under Ex.B.17 and that the price list issued by the Secretary, AMC, Asifalrad Ex.B.1B. lt was found by the reference court that in the acquired land, crops such - as redgram and cotton were being grown giving an annual yield of Rs.3,39Bl per acre per annum and the net income was Rs.1,530/- per acre. By applying a multiplier of '16', the reference court awarded Rs.20,000/- per acre as compensation, although the price of land worked out to Rs.24,4801.

7. No cross objections have been filed with regard to the enhancement in the market value of the land acquired. As the market value of the acquired land comes lo more than Rs.20,000/- as per the formula i.e., Rs.l,5301 x 16 = Rs.24,4801. Therefore, the said appeal filed by the State is dismissed. B. Coming to the question of determination of price with regard to the houses, Ex.B.20 is the valuation ol structures of Mandrumeda issued by R.W.l 1, who is a private architect. According to him, the average price of the house is more than three times the amount awarded by the Land Acquisition Officer. However, the land owners have claimed only one time the compensation over and above what was awarded by the Land Acquisition Ofiicer. By considering the valuation report under Ex.8.20, we find that the claim ol the land owners is justified as the structures have been evaluated to be more than three times the valuation as assessed by the Land Acquisition Officer. Thus in our considered view, lhe land owners would be entitled to twice the compensation awarded by the Land Acquisition Officer for the slructures.

9. Accordingly, cross objections liled by the land owners are allowed and the appeal filed by the State is dismissed. The land owners shall also be entitled to all the statutory benefits under the Land Acquisition Act. No cosls. As a sequel, miscellaneous petitions, if any pending in this appeal shall stand closed.
