The Court made the following: COMMON ORDER ,i I THE HONOURABLE SRI JUSTICE K. SURENDER CRIMINAL PETITION No.9l28 OF 2O2l ALONG WITH I.A.Nos.2 & 3 OF 20 2S COMMON ORDEI1. This Criminal Petition is filed under Section 482 Cr.p.C., against the petitioners/Al to 44 seeking to quash the proceedings in C.C.No.1 1i 7 o{ 2021 on the file of the Courr of XXIII Metropolitan Magistrate at Medchal Court, Medchal District. The offences alleged against them are under Sections 498-,{ of the Indian Penal Cocle and Sections 3 and 4 of the Dowry prohibition Act.
2. Heard learned counsel appearing for the petil_ioners and learned Additional Public Prosecutor for the State. perused the record.
3. The petitioners/Ai to ,,\4 are being prosecuted by the 2.d respondent for the above said offences. The 2'd respondent /defacto complainant in the complaint aleged that she married Accused No. 1 in the year 2or4 and therea-fter several disputes arose between them.
4. However, thev have filed petitions i.e., LA.Nos.2 & 3 of 2O2S seeking indulgence of this Court to quash the proceedings on the ,/1 ground of compromise along with a Memorandum of \.i Understanding.
5. Keeping in view that the offerrces alleged against the petitioners are under Sections 498-A of IPC and Sections 3 and 4 of the Dowry Prohibition Act and disputes are amongst the spouses, this Court deems it appropriate to allow compounding of offences and quash the proceedings.
6. The parties herein have filed a joint memo of compromise stating that they have settled the disputes between them amicably and 2"d respondent has no objection to quash the proceedings against the petitioners herein in the above Case. The said joint memo of compromise and Memorandum of Understanding are placed on record.
7. Both the parties are present in person and identified by their respective counsel. The parties, who are present in the Court, admit the Compromise. When learned Additional Public Prosecutor questioned, the defacto complainant/ 2na respondent stated that she has no objection llt quashing the proceedings against these petitioners/Al to A4. Copies of Aadhar Cards are also filed. I I -----7 In view ol the compromise entered between the 8. petitioners/A1 to ,A4 and respondent No.2, I'A'Nos'2 & 3 of 2025 is allowed. Consequently, the Criminal Petition is allowed and the file ol XXIII proceedings in C.C.No.11 17 of 2O2l on -the Metropolitan Magistrate at Medchal, Medchal District, is hereby quashed against the petitioners/Al to A4.
