This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Crimrnal Petition and upon hearing the arguments of Sri S.Ram Reddy, Advocate for the Petitioners and the Sri M.Vivekananda Reddy, Assistant Public Prosecutor on behalf of the Respondent No. 1 and of Sri N.Krishna Sumanth, Advocate for the Respondent No.2. JUSTICE JUWADI SRIDEVI l.A.Nos.2 and 3 of 2025 in/and CRIMINAL PETITION No.9730 of 2023 COMMON ORDER: This Criminal Petition is filed under Section 482 ot Cr.P.C. by the petitioners/accused Nos.1 to 3 to quash the proceedings against them in C.C.No.1470 of 2021 on the file of Judicial Magistrate of First Class at Sircilla, registered for the offences punishable under Sections 447,323,504, 506 r/w 34 of IPC and Seclion 156(3) of Cr.P C
2. lt is submitted by learned counsel appearing for the petitioners as well as the respondent No.2, that during pendency of the preseht Criminal Petition, the parties have compromised the matter and accordingly, l.A.Nos.2 and 3 of 2025 have been filed to record the compromise between them and to compound the offences
3. Vide order dated 18.06.2025, this Court directed the parties along with their respective counsel to appear before the Secretary, High Court Legal Services Committee, High Court for the State of Telangana, Hyderabad, for identification and to submit a report
4. Pursuant to the above said direction issued by this Court, the parties have appeared and the Secretary, High Court Legal 2 !-E,: 'rl Services Committee, has identified the parties and submitted a report, dated 30.06.2025 and the same is placed on record.
5. ln view of the above, l.A.Nos.2 and 3 of 2O2S are allowed. Consequently, this Criminal petition is allowed and the proceedings against the petitioners/accused Nos.1 to 3 in C.C.No.1470 of 2021 on the file of Judicial lVlagistrate of First Class at Sircilla, are hereby quashed. It is submitted that the complainant was motivated and provoked to file the complaint by one Matta Rani and Matta Santosh Redcly who arc close relatives of Accused nos.l to 3 as they were having sorne land disputes pertaining to .esidential house plot and the said plot was sold by Matta Rani to respo,dent no.Z and subsequently responde,t no.2 transfer-red the said open land in favour of Matta Rani,s son (Santosh Reddy). Respondent No.2 has nothing to do with the disputes between Accused Nos.l to 3 and Matta Rani, no one trespassed into respondent no.2,s properly nor rnanhandled him at any point of time and the said complaint is rnotivated, plovoked by Irlatta Rani. ) 4 After registeri:rg the present FIR and came to knorv abor.rt the charge sheet filed along u'ith the statements the respondent no.2 has approached the Accused No. I and revealed that it was a motivated complaint filecl on the p|ovocation of' Matta Rani and others. It is submittcd that thc responclcnt no.2 has nothing to do with the present criminal proceeclings and respondent rLo.2 has filed the saici complaint under the ln fluencelpr.e ssure and except the signing on the complaint, respondent no.2 does not knorv the contents o1-the complaint and the police have never exarnined him. Accused Nos. I to 3 have filed o.s.No.249l2020 befo.e the Hon'bie Junior Civil Judge, Sircilla against complainant herein and Matta Rani with a claim for declaration of easementary rights and the said suit is pending. As the complainant has registered the said property in favour of Santosh Reddy S/o Matta Rani and there are no claims against the complainant -W- s*^/ V 'l ^/ w..i:.-* -; t:?e;)8 I 5 herein, hence the suit in O.S.No.24912020 agatrst the complaint herein is not presscd. It is submitted that due to the intervention of elders of both sides the Accused and complainant have come to a compromise and to avoid lengthy trial procedure both the parties have come up to settle their disputes amicably and in these circumstances it is just and necessary to quash the present C.C.No. 1470 <tf 2021 on the file of Hon'ble Judicial Magistrate of First Class, at Sircilla. It is therefore prayed that this Hon'ble Court may be pleased to record cornpromise and quash the proceedings in C.C.No. l47O of 2021 on the file of Ifon'ble Judicial Magistrate of First Class, at Sircilla, against Accused Nos.l to 3 and be pleased to pass such other and further order/s as this Hon'ble Court may deem fit and proper in the circumstanceg ofthe case.
