Petition under Arlicle 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, order or direction; more particularly one in the nature of Writ of mandamus declaring the inaction of the Respondent No.2 to 4 in considering the representation Dt.25-05-2025 in providing the police aid to schedule of property by implementing the judgment DT.29-03-2011 in OS No. 158t2O1O by the Prl Junior Civil Judge, Siddipet is highly illegal, arbitrary and in &- violation of violation of Principles of Natural Justice and also in violation of Article 14, 19, 21 and 300-A of constitution of lndia, consequently direct the Respondents No.2 to 4 to provide police aid to the Petitioners agriculture land by implementing judgment Dt.29-03-2011 in OS No. 15812010 by the Prl Junior Civil Judge, Siddipet lA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondent No.2 to 4 to consider the representation of the Petitioners Dt. 25-05-2025 and provide police aid to the Petitioners agriculture land by implementing the judgment Dt.29-03-201'1 in OS No. 15812010 by the Prl Junior Civil Judge. No.25283 of 2925 Heard the learned counsel for the parties and with their consent this writ petition is disposed of at the threshold.
2. 'Questioning inaction on the part of the respondents No.2 to 4, Commissioner of Police, Siddipet Police Commissionerate, Assistant Commissioner of Police, Siddipet Division, Station House Officer, Dubbaka Police Station, respectively, in considering the representation dated 25.05.2025 in providing the Police aid to schedule of property by implementing the judgment dated 29.O3.2OLI in O.S. No.158 of 2010 passed by the Principal Junior Civil Judge, Siddipet, petitioners liled the present v;r;i petition.

The learned counsel for the petitioners would submit that the petitioners are the absolute owners r,ir:.d possessors of certain extents of land in Sy.No.L523l432/1 & 2, situated at Dubbaka village and Mandal, Siddipet District. When the respondents No.5 to 9 were illegally trying to interfere with the said land, petitioners filed O.S. No.158 of 2OlO before the Principal Junior Civil Judge, Siddipet against the respondents No.5 to 9 and obtained orders restraining the respondents No.5 to 9 from illegal interference with the said land. Due to the disobedience of the Court order by the respondents No.S to 9, petitioners approached the respondent No.4, Station House Officer, for providing police aid for implementation of the judgment passed in t/ 2 O.S. No.158 of 2OtO but the respondent No.4 failed to provide the sarne. Hence, the petitioners made an application dated 25-05.2025 with a request to implement the judgment dated 29.O3.2O11 passed in o.s. No.158 of 2OLO and protect the said land from illegal enc.roachers. Since, there.was no action on the said representation by the respondent No.4, petitioners filed the present writ petition.
4. On the other hand, the learned Assistant Government Pleader for Home, placed a copy of the written instructions dated 22-O8.2025, based on which it is submitted that initially based on the complaint lodged by the petitioners, respondent No.4, made GD entry on
25.05.2025 at 18.O0 hours and also petition entry vide ID No.OO372, dated 25.05.2025 and while conducting enquiry, the complainant came to the Police Station and given a hand written representation stating that after giving complaint, he had discussed the matter with the alleged respondents and they both came to a consensus to get the land surveyed and d.emarcated by a surveyor and requested not to take any action on his complaint. Accordingly, the complaint dated
25.05.2025 lodged by the petitioners was closed as compromised on
02.06.2025. It is further submitted that the petitioners once again given another complaint dated 28.05.2025 stating that when the unofficial respondents tried to illegally encroach their land, they filed O.S. No.158 of 2OtO before the Court of Principal Junior Civil Judge, Siddipet and the Court had granted injunction order on 29.03.2O1I- Later they filed E.P. No.l of 2017 wherein the Court passed .order 3 dated 24.08.2022 for their civil imprisonment. On 25.05.2025 at
10.30 while leveling the land, one Mr. Istarigall Charan Teja, Advocate has come to their land and threatened to register SC/ST cases and also threatened to grab the complainant land and requested to take action against the said person. Based on the said complaint, the'respondent No.4 made GD entry on 28.05.2025 and also petition a t I entry vide tD No.00387 dated 28.05.2025 and as per the enquiry, it is revealed that the dispute pertains to civil in nature and moreover, suit in O.S. Nb.158 of 2OlO is pending before the Junior Civil Judge, Siddipet. As such, the complaint was closed as civil in nature on
02.06.2025.
5. In that view of the matter, since the respondents have already acted on the representation dated 25.A5.2025 and after making a detailed enquiry, the complaint was closed as civil in nature on
02.06.2025 hence, it cannot be said that the respondents did not act on the representation dated 25.05.2025. However, since the civil dispute is pending before the Court of law, the petitioners shall pursue their remedies as available under law.
