SREENIVAS RAO I.A.Nos.1 and? of2025 IN/AND CRIMINAL PITTTTION No.9623 of 2023 COMMO N ORDER: This Criminal petition has been filed under Section 4g2 of the Code of Criminal procedure, 1973 (for short, 'Cr.P.C.') by the petitioners, who werb arrayed as accused Nos.l to 4, seeking to quash the proceedings in C.C.No.l670 of 2023 on the frle of rhe V Additional Metropolitan Magistrate at L.B.Nagar, for the offences punishable under sections 498(A) of the Indian penal code,, l g60 and Sections 3 and 4 of the Dowry prohibition Act, 1961.
2. During the pendency of this criminal petition, petitioners/accused Nos.l to 4 and respondent No.2/de_facto complainant have entered into compromise to resolve the disputes pending between them and filed joint affidavit along with I.A.No.2 of 2025 and also filed another I.A.No. I of 2025 to record the compromise and to compound the \ offences. 2
3. The above said applications came up for consideration before this Court on02.09.2025, and this Court directed the petitioners/accused Nos. I to 4, ar-.d respondent No.2/de-facto complainant, to appear before the Secretary, Telangana High Court Legal Services Committee, along with their identity cards for their identification, on or before 06.09.2025, ard further directed the Telangana High Court Legal Services Committee to submit a report by lO-09.2O25. Pursuant to the same, Telangana High Court Legal Services Committee submitted reporl dated O4.O9.2O25 -

Heard Mr.M.Dinesh Reddy, learned counsel representing Mr.Rapolu Bhaskar, learned counsel for petitioners and Mr.I(.Bheemayya, learned counsel representing Mr.P.Srikar, learned counsel for respondent No.2. 5- Both the counsel submitted that the petitioners/accused Nos.l to 4 and respondent No.2 entered into compromise at the instance of their well wishers and elders and settled their I I i I I l ' I t t-.'*YT 3 disputes. The terms of compromise were mentioned in the joint affidavit frled in support of I.A.No.2 of 2025.
6. Taking into consideration the above facts and crrcurristances including joint memo frled by both the parties, proceedings in C.C.No.167O of 2023 on the fite of the V Additional Metropolitan Magistrate at L.B.Nagar, against the petitioner/accused Nos. I to 4 are liable to be quashed.
7. Accordingly, I.A.Nos. 1 and 2 of 2025 are allowed. Consequently, the criminal petition is allowed and the proceedings in C.C.No.1670 of 2023 on the file of the V Additional Metropolitan Magistrate at L.B.Nagar, against the petitioner/accused Nos. Basing on the above compraint, the porice women porice station, saroor Nagar has registered a case in Crime No. 150/2023 for the offences under section 498-4 Ipc and sec-3 & 4 of Dowry Prohibition Act, 1961, against the petitioner herein. # 2' It is submitted that the investigation officer in the above case, without proper invesiigation fired a finar report for the offences mentioned above. The Hon,bre v Addr, Metroporitan Magistrate at LB Nagar, without rooking into the facts of the case, taken the cognizance of the offence punishabre section 498-4 IpC and Sec-3 & 4 0f Dowry Prohibition Act, 1961, against the Petitioners herein and registered the charge sheet as cc. No. 167012023. 3' It is submilted that during the pendency of the above case, the petitioners and the Defacto comprainant/2"d Respondent have compromised the matter at the intervention or the elders and we'-wishers.
