LAKSHMAN WRIT PETITION No.24922 of 2025 ORDER: Heard learned counsel for the petitioner, Sri L. Ravinder, learned Assistant Government Pleader for Revenue and M.Srikanth Reddy, Iearned Standing Counsel for 4th respondent.

2. Petitioner herein is claiming that he is the absolute owner and possessor of land admeasuring Acs.5.0O guntas in Sy.No.148/3, situated at Kallakal Village, Manoharabad Mandal, Medak District, on the strength of the registered sale deed bearing document No.3O12 of 1999 dated

14.10.1999. His name was mutated in the revenue records and pattadar pass books were also issued. Thereafter, the

3.d respondent issued notice dated 22.17.2006 calling upon the explanation from the petitioner as to why the said land cannot be resumed. Challenging the said notice, petitioner has filed Writ Petition No.2952 of 2009. Vide order dated 25.17.2013, this Court allowed the said Writ Petition setting aside the said notice. However, this Court granted liberty to the respondents to acquire the said KL,J \\ P.No.24922 of 2025 2 propert)' by following the due procedure lai,l dorvn under law, if ttre same is for public purpose.

3. Thercafter, the petitioner has r;ubm:.tted a representirtion dated 29.06.2O75 to the 3.d respondent with a reque st to enter his name in the revenue records including pahani copies. The Revenue Divi:;ional Officer, Siddipet, called for report from the 3.d rer;ponclent vide proceedings in Lr.No.D/5069 l2015, dated O2.07.2015. The

3.1 respondcnt submitted memo vide Lr.No.B/l4ll2Ol4, dat.ed 212.08.2015, recommending to include the name of the petilioner. In the said memo, it is also n: entioned that pending finzrlization of the case by the TSIIC, the order will not conform any rights and as per orders of l.igher officers, further erction will be initiated as per orders o. this Court in W.P.No.i2952 of 2009. Thereafter, petitioner [-ras filed Writ Petition No.64O of 2O2O to declare the rrction of the respondr:nts 2 and 3 in not issuing new digitarlized pattedar passbooks and title deeds in his favour in respect of the subject property. Vide order dated 22.O1 .201,i0, this Court disposed of the said Writ Petition directing the competent ,,/ KL,J W .P .No .24922 of 2O2S 3 authority to consider the representation dated 02.05.2019 submitted by the petitioner and take action in accordance with iaw, within a period of eight weeks from the date of receipt of a copy of the order. Vide pr.oceedings dated

29.04.2024, the 3.a respondent called for report from the 4ft respondent. The 4th respondent has not submitted any report so far. Therefore, petitioner has submitted a representation dated 12.02.2024 to the 3.d respondent during prajavani with a request to include his name ln revenue records and issue pattadar passbooks. Despite receiving and acknowledging the said representation of the petitioner, the 3.a respondent did not act upon the same Aggrieved by the said inaction of the 3'd respondent, petitioner frled the present Writ Petition.

During pendency of the said representation dated L2.O2.2O24 submitted by the petitioner, the State has promulgated the Telangana Bhu Bharathi (Record of Rights 1n Land) Act, 2025, which came into effect from I4.O4.2O25. The State has also framed Bhu Bharati Rules, 2025, vLde G.O.Ms.No.39, dated 14.04.2025. In the said KL,J W .P.No.24922 ol 2025 4 \ Rules, the concerned authorities are specifici:rlly mentioned in Scherlule-A and valuation in Schedule-B. Iherefore, the petition€rr has to submit online applicrrtion to the concernr-'d authority in terms of Schedule-A r,Lnd Schedule- B of the Bhu Bharathi Rules, 2025 along with all the relevant documents and it is for the competerrt authority to consider the same and dispose it of in accordilnce with law.

In the light of the said discussion, this \{/rit Petition is disposed of granting liberty to the petitior er to submit online application to the competent authorit'g as specified in Scheclule-A of Bhu Bharati Rules, 2025 r,rlong with all reievant documents with a specihc request to enter his name in revenue record and issue e-pattadi,Lr pass book. On receipt of the said online application, t.:te cor.npetent authorit5r shall consider and dispose it of i1 accordance with lavr,. If the competent authority is not inclined to accept the request made by the petitioner, ht:. shall pass a reasoned. order ald communicate the said order to the petitione r.
