LAKSIII,IAN 1VRIT PETIT ON No.24917 of 2o.25 I ORDER: Heard learned counsel for the petitioner, Sri L.Ravinder, learned Assistant Government pleader for Revenue and M. Srikanth Reddy, learned Stalding Counsel for 4th respondent.

Petitioner herein is claiming that he is the absolute owner and possessor of land admeasuring Acs.5.OO guntas in Sy.No. 148/2, situated at Kallakal Village, Manohrabad Mandal, Medak District, on the strength of the registered sale deed bearing document No.3013 of 1999 dated 10.11.1999. His name was mutated in the revemre records ald pattadar pass books were also issued. Thereafter, the 3'd respondent issued notice dated 22 .l l .2006 calling upon the explanation from the petitioner as to why said land cannot be resumed. Challenging the said notice, petitioner has filed Writ petition No.2951 of 2009. Vide order dated 13.11.2013, this Court allowed the said Writ Petition setting aside the said notice. However, this Court granted liberty to the respondents to acquire the said I I KL,J W.P.No 24917 of 2025 :. 2 property by following the due procedure laid down under law, if the same is for public pulpose' 3. Thereafter, the petitioner has submitted a representation dated 29 '06 2Ol5 to the 3'd respondent with name in the revenue records a request to enter his The Revenue Divisiona-1 Offrcer' including Pahani copies Siddipet, cailed for report from the 3'd respondent vide proceedings in Lr'No D/5 069 l2015' dated' 02'07'2015 The 3.d respondent submitted memo vide Lr'No'B/ 141 l2014' dated22.OB.2015,recommendingtoincludethenameof the petitioner. In the said memo' it is a'lso mentioned that pending finaiization of the case by the TSIIC' the order will not conform any rights and as per orders of higher officers' furtheractionwillbeinitiatedaSpelordersofthisCourtin W.P.No.2951 of 2OO9' Thereafter' petitioner has filed Writ Petition No.89O of 2O2O to declare the action of the respondents 2 and 3 in not issuing new digitalized pattedar passbooks and title deeds in his favour in respect of the subject property. Vide order dated 05'03 2020' this Court disposed of the said Writ Petition directing the competent / KL.J W.P.No.24g17 of 2ois J authority to consider the representation dated 02.OS.2Olg submitted by the petitioner and take action in accordance with law, within a period. of eight weeks from the date of receipt of a copy of the order. Vide proceedings dated 29.04.2024, the 3.a respondent called for report from the 4th respondent. The 4th respondent has not submitted any report so far. Therefore, petitioner has submitted a representation dated I2.O2.2O24 to the 3.d responde,nt during prajavani with a request to include his name in revenue records and issue pattadar passbooks. Despite receiving and acknowredging the said representation of the petitioner, the 3.a respondent did not act upon the same. Aggrieved by the said inaction of the 3.d respondent, petitioner filed the present Writ petition. 4' During pendency of the said representation dated 12.02.2024 submitted by the petitioner, the State has promulgated the Telangana Bhu Bharathi (Record of Rights in Land) Act, 2025, which came into effect from 14.04.2025. The State has also framed Bhu Bharati Rules, 2025, vide G.O.Ms.No.39, dated 14.04.2025. In the said KL,J w.P.No.24917 of 2025 , 4 Rules, the concerned authorities are specihcally mentioned in Schedule-A and valuation in Schedule-B' Therefore' the petitioner has to sr'rbmit online aPPlication to the concerned competent authority in terms of Schedule-A and Schedule-B of the Bhu Bharathi Rules' 2025 along with all the relevant documents and it is for the competent authority to consider the same and dispose it of in accordance with law' In the light of the said discussion' this Writ Petitron ts 5. disposed of granting liberty to the petitioner to submit online application to the competent authority as specified in Schedule-A of Bhu Bharati Rules' 2025 along rvith a1l relevantdocumentswithaspecificrequesttoenterhis name in reventle record' and issue e-pattadar pass book' On receipt of the said online application, the competent authority shall consider and dispose it of in accordance with iaw. If the competent authority is not inclined to accept the request made by the petitioner, he shall pass a reasoned order and communicate the said order to the petitioner. However, he shall complete the said exercise KL,J W.P.No.24977 of 2025 5 within a period of 3O days from the date of receipt of such online application.
