Ju-srice lirurrrula Deut Eadct) This appeal, uncier Scction 54 of thc Land Acquisition Act' 1894, (for shorl 'the Act') is prelerred by the Special Deputy Collector, L.A.Cum Loc Unit, SRSP, Pochampad, aggrieved by the order and decree dated 22.08.2006 passed in O P No'385 of 2OO2 by the learned District Judge at Nizamabad (hereinafter referred to as 'the reference Court').

For convenience and clarity, the parties hcrein are referred Lo as [hey u'ere arrayed before the reference Cour[ Ti're facts of the case in bnef are lhat the Gove rnment has 3. acquired house sites, struclures ctc, ln Umrneda Villagc of Nandipet Mandal, Nizamabad District for Pochampad Project A clraft notification under Section a(l) of the Act was published in A.P.Gazeltc on 1O.02. 1981. The Land Acquisition Office r has passed the award on 28.02. 198 1 '

The case of the claimants is that thcy are residenls of Ummeda village of Nandipet Mandal and the house siLes' structures, drinking water r.l'ells etc., situated in Ummeda village 2 AKS,J & ETD,] LAAS No.637 2007 were acquired by the Land Acquisition officer and that dissatished with the meager amount of compensation, some people from their village Iiled protest application under Section 1g of Act and lhe matter was referred to the Court of Additional District Judge, Nzamabad in o.p.No.213 of 199o and that after due enquiry, the Additional District Judge, Nizamabad has enhanced the compensation and also has awarded solatium and inLerest on the enhanced amount vide judgment and decree dated 30.09.1994. Aggrievcd by the said award, the Land Acquisition Officer has preferred an appeal in A.S.No.2O02 of 1995 which lva s dismissed by the High Courr on 31.03.1998.

The claimants in the present case who have not availed to file protest application undcr Section 1g of the Act have approached the Land Acquisition officer under Section 2g-A and requested him to re-determine the compensation for thcir acquired properties, in terms of thc above said order of the Additional District Judge, Nizamabad. Finally, the Land Acquisition Officer has passed an award No.42/9g_99 dated 18.01.1999 withholding the payment of interest on solatium, which is illegal and contrary to law and that the Land Acquisition Officer has arbitrarily calculated the interest on the enhanced compensation only upto 15.09.199g though he passed the awarcl AKS,I & ETD,J LAAS No 637,2007 3 onlS,ol.lgggandthatthechequeswerehonouredbythebank on 16.03.1999 and thus, the Land Acquisition Officer ought to have calculated the interest up to 16 03 1999' Thus' their application was refcrred to the District Judge' Nizamabad'

6. The referencc Court has framed the following issues for adj udication: " 1. Whethcr the clalmants are entitled for payment of inlerest on solatium? 2. At lhc time of trial, PW1 was examined and trxs A1 and A2 behalf of the claimants and on behalf of lhe lvcre marked respondents, RW1 was examined and Ex Bl was marked Basecl on the evidence on record' the refercnce Court has 8. ordered to pay the interest on solatium as per the orders in O.P.No.213 of 199O and also directed to calculale and pay the interestonthemarketvalueandsolatiumupto16.03.1999,the date on which the cheques were honoured by the S'B'H @ 15% ./ 4 AKS,] & ETD,J LAAS No.637 2007 per annum as per the L.A.Act and further directed to pay interest @ 12% per annum on the accumulated interest by way of equitable interest from 17.03.1999 till the payment. Aggrieved by the said award, the appeal is preferred by the Special Deputy Collector, L.A.Cum Loc Unit, SRSp, pochampad.

9. Heard the submissions of learned Government pleader for the appellant and Sri S.Niranjan Reddy, learned counsel for the respondents

The learned Government pleade r has submitted that the order and decree of the reference Court is contrary to law and weight of evidence and further argued that ihe reference Court has made an error in awarding equitable interest from i 7.03. 1999 till the date of payment @r2,'/o per annum. He further argued that the reference Court failed to takc notice of the principles laid down by the Hon,ble Supreme Court saying that equrtable interest cannot be granted in such cases and that granting interest on interest is against any legal principle. He therefore, prayed to set aside the orders passed by the reference Court.

The learned respondents counsel, on the other hand, has submitted that the claimants have suffered a lot due to the delay made in payments and that they suflered loss for none of their AKS,J & ETD.J LAAS No.637-2007 5 wrongs and that they are very much entitled to the interest as a\\'arded bY the reference Court'

POINT NO.1: a) The grievance of the appellant in the present case is that the reference Court has granted interest @)72o/o on accumulated. interest from i 7 03 1999 till the date of payment The case of the claimants is that they suffered a lot due to b) thc delal'cd payment made to them and that the Land Acquisition Officerhascalculatedinterestforoneyear(@gokfrom28.02.1981 to 27.02.1982 and 157o lrom 01 03 1981 to 15 9'1998 on the enhanced amount excluding soiatium. Thus, the clairnants were aggrieved by thc Land Acquisition Officer Au'ard for not arvarding I interest on solatium. \ \ 6 AKS,J & ETD,] LAAS No.637 2007 c) It is pertinent to take note of the fact that in O.p.No.213 of 1990 hled under Section 18 of the Act arising out of the same acquisition, the reference Court has enhanced the compensation and has awarded interest on the enhanced amount and solatium. d) The present case arises out of the other claimants who sought redetermination of compensation under Section 2gA of the Act, thus, the reference Court ought to have taken into consideration the award passed in O.p.No.213 of 199O and should have passed lhe award in similar lines wherein thc decree has provided for payment of interest on the enhanced amount and solatium. But it nowhere specified to grant interest on interest. e) The reference Court has referred to Sunder o. Union of Indiq.l, wherein it was held that sola[ium forms part of compensation payable to the land owners, hence, interest is payable on the amount of solatium also. If the reference CourL has awarded interest on solatium, that could have been sufficienl. 0 But in the present case, the reference Court has also awarded interest on accumulated interest. Admittedly, there is a delay in payment of compensation, when the acquisition has \ \ 'zoor 121 rncc :+r 7 AKS,J & ETD,I LAAS N0.537 2007 taken place in the year 1981, the present reference was made in the year 2002. g) The relerence Court has observed that if a pleading and avcrmenl is not denied by the opposite party,- it can be taken as an admission and further held that the categorical admissions of RWI with regard to the delay in making payment show that there is inaction on part of the Land Acquisition Ofhcer and thus, r'ent ahead in au,arding Lhe interest on accumulated interest' The relevant provisions ut-rder Section 28 and 28A of the Act are extractecl hereunder for the sake of reference: "28. Collector may be dirccted to pay interest on excess compeDsation ll 15q 5urn, whrch lh; Collcclor did award as compensation, the award oI the Court may direct Lhat the collcctor shall pay interest on such exccss at the rate o[ lnine per centum] per annum from the date on which he took posscssion of the land to lhe date ol paymcnt of such cxcess into Court: Provrdcd Lhat the award o[ the Courl may also direct that whcrc such exccss or any part thereof is patd inLo Court alter Lhc date or cxpiry of a perioci of one 5'ear from thc date on which posscssion is taken, interest aL thc rate (,l lilteen pcr cenLum per annum shall be payable from lhe datc oI expirl of thc said period of one year on the amount of such- exccss or parl thereol rvhich has irot been paid into Coult bcfore thc date of such expiry' 28A. (3) Any pcrson who has not accepted the award under sub-scction (2) may, by written application to the Collector, required that thc matter be refcrrcd by the Collcctor for the dcterminatlon of the Court and the provisions ol sections 18 Lo 28 shali, so far as may be, apply Lo such rcference as Lhey apply to a reference undcr section I8." 0 I t is nowhere mentioned in the Act that interest shall be again calculated on the accumulated interest to workout equitable intcrest. Jus[ because RW1 has not denied the plea of the claimants, it does not mean to say that thc reference Court should take it as an admission by the Land Acquisition Officer to grant interest on interest. Thus, granting of interest @ l2o/" per annum on the accumulated interest, awarded by the rcference Court is not tenable in the eye of law. Hcnce, it is opined that thc order o[ the reference Court to the extent of granting interest @ l2%o pcr annum on the accumulated interest from 17.03. i999 till the date of payment, is liable to be set aside, while confirming thc remaining part of the award. Point No.1 is answered accordingly.

14. POINT NO.2: In view of the reasoned finding arrived at Point No.1, it is held that the order and decree of the reference Court needs to be modified only with regard to the payment of interest on interest. "/ 9 AKS,] & EID,J LAAS No.637 2007

L2o per annum on the accumulatcd interest flom 17.03.1999 till the date of payment, u,hile confirming the remaining part o[ the award. No costs.
