VIJAYSEN REDDY WRIT PETITIO N No.24703 oF 2025 ORDER:(ORAL) This writ petition is filed seeking to declare the inaction of respondent Nos. 2 to 5 pursuant to the legal notice/representation dated 11.08.2025 submitted by the petitioner regarding unauthorised construction raised by respondent Nos'6 and 7 in PlotNo.S6inSy.No.238situatedatPuppalagudaVillage' Serilingampally Zone, Ranga Reddy District' as being arbitrary and unconstitutional'
2. lt is the case of the petitioner that she is the absolute owner and possessor of Plot No'86' admeasuring 276 square yards, in Survey No'238 of Puppalaguda Village' Gandipet Mandal, Ranga Reddy District' having purchased the same under registered sale deed bearing document No'4541 of 2013 dated 24.O6.2}13from the previous owner Smt' B' Balamani' who had title to the property under registered sale deed bearing document No.7312 of 2003 dated 29'09'2003' lt is stated that the petitioner is resident of East Godavari, Andhra Pradesh' Taking advantage ofherabsence,respondentNos6andThavetrespassedintothe saidPlotanddemolishedthecompoundwallandraisingamulti- .@ . \-::,i?al?::. }\. - \'t:'.\ v, \ 2 storied RCC structure without sanctioned permission or approval from the GHI\4C. ln that connection, the petitioner issued legal notice/representation dated 11.og.2ozs to respondent Nos.2 and 3 requesting them to take action regarding unauthorised construction made by respondent Nos.6 and 7 over the subject property, but so far action is not taken.
3. Heard Ms. A. Satyasiri, learned counsel for the petitioner, and Mr. G. Madhusudhan Reddy, learned Standing Counsel for Greater Hyderabad Municipal Corporation (GHMC), appearing for respondent Nos.2 to 5, and perused the materiar available on record. 4 Learned Standing Counsel for respondent Nos.2 to 5 submitted that appropriate action will be taken on the legal notice/representation dated 11.Og.2O2Sof the petitioner
5. ln view of the above submissions, the writ petition is disposed of directing respondent No.4 _ Deputy Commissioner, GHMC, Tank Bund Road, Hyderabad, to forthwith take action on the legal notice/representation of the petitioner dated 1 1.Og.2025, for removal of structures allegedly made without any sanctioned plan by respondent Nos.6 and 7 in plot No.g6, Survey No.23B, 3 Puppalaguda Village, Serilingampally Zone' Ranga Reddy District, by issuing prior notice and affording opportunity of hearing to the petitioner and respondent Nos'6 and 7' and pass orders in accordance with law' This exercise shall be completed within a period of two (02) months from the date of receipt of a copy of this order. Notice to respondent Nos 6 and 7 is dispensed with as this order is passed without entering into the merits of the case. However, if respondent Nos'6 and 7 have any grievance regarding this order, they are at liberty to seek modification of this order.
