Tttefacts of the case in brief as stated are that the Ai-Quadri petitioner's grandfather Syed W aliullah Hussatnr was [he originai Waqif of Sajjadah Naheen of Dargah Imam Ali Shah and had developed the Dargah and Har,ral Government of the said Muntakhab was Published 1n Asifjah 1351 Fasti' 12(h Rabbi Ui Awwal Hijri uide File No.269 l2 Auqaaf Section 135O Fasli' The founder has 7 sons, later the founder died on 23'03'1957 and all the children died subsequently. Per contra, Government Pleader Mr.M.Srinivas, learned Assistant for Home has Piaced a coPY of Assistant Commissioner of Police' proceedings issued bY Chand.rayangutta Division clated 16'OB'2025' wherein permlsslon was granted to one Syed Zainul .Abideen Hussaini Quadri (Mob No'9885093523) for performance of Annual Urs of Syed Sha lmam Shah Al Hassani Wal Hussainin Al-Quadri (R'A')' Balapur Dargah' Hyderabad with certain conditions ftom 20'OB'2025 to 23'O8'2O25' ort his application' Lcarned Assistant Government Pleader has also placed a copy of proceedings of Chief Executive dated 18.12.2022 Ofhcer, Telangana Waqf Board appointing SYed Zainui Abideen presiclent of TowLiath Committee for 1995, as such the under Section 63 of Waqf Act' permission for performance of Annual Urs-e-Shareef is granted in his favour ' a period of 3 Years Hussaini Quadri AS

The main grievance of the petitioner is that while the petitioner dated 07 'OB'2025 the aPPiication of pending for consideration' respondent authorities have granted permission to one Syed Zainul Abideen Hussain 1S -,k 4 Quadri on 16.08.2025. Learned counsel would reiterate that petitioner was eariier granted permission for Performance of Urs-e-shareef on last fcu, occasions. However, the present applicalion dated neither disposed of nor rejected b1, authorities. Learned counsel for the petitioner, on rnstructions, w.ould submit that petitioner r,r.ould join in the procession held by Syed Zainul Abideen Hussaini euadri and r.r,ould cooperate for the peaceful conduct of the O7.08.2025 was the respondent processron and ceremonies.

6. Learned Assistant Government pleader would submit that petitioner,s application datcd O7.t)8.2O25 has been rejected. However, the copy of rejection order has not been fiied. 7 In that view of the matter, w.rthout goir_rg into the merits of the case, this Court deems it approprlate to dispose of the writ petition permitting the petitroner to join the Urs-e-Shareef procession to be conducted b1. one Syed Zainul Abideen Hussaini euadri as per permrssion dated 16.08.2025 and conduct ceremonies with peace and wF harmony. The respondent/ Police are directed to give Police Bandobust to the Urs-e-shareef scheduled to be held from

20.08.2025 to 23.08.2O25 from 06.00 PM to 10.00 PM subject to the condition thaL both the groups shail foilow the conditions prescribed in proceedings of Assistant Commissioner of Potice, Chandrayangutta dated

16.O8.2025.It is made ciear that this order is confined only to the extent of Urs-e-Shareef scheduled to be held from 2O.O8.2O25 lo 23.08.2025 and this order shall not be treated as precedenl. It is made clear that if there is any untourard incident, the respondent/ Police shall take appropriate action strictly in accordance to law. B.
