'fhis w.rit pctition is filed aggrievecl by the action of the responrlent No.2/Cornmissioner of Police, Rachakonda Commissionerate in not giving necessary orders to the 3.t responclent l.rereitr pursuant to the complaint datcd 11.08.2025, for taking action against tire un-official responcftrnts basing on the complaint dated 76.07 .2025 which was closed, withou t assigrring any reasol-ls as being illegal, arbitrary, unjust and unconstitutional anc'l seeking a consequential direction to 2.d respondent to issue necessary orders pursuant to the complaint dated 11.08.2025

'l'he facts itr brief are that the petitioners marriage was perforrnecl witlr respondent No.4 on 27.04.2024 as per Hindu rites and custorns antl ;rt the tirne of marriage her parents gave 25 tulas of gold, B lakhs cash and certain other amounts for the purpose of marriage. Learned Assistant Govemment Pleader appearing for Home has placed the written instructions submittecl by Sub-Inspector of Police, Madgul Police Station, Rachakonda Commissionerate wherein it is submitted tl'rat petitioner lodged a complaint dated 1.6.07.2025 with respondent No.3 against the respondent Nos.4 to 8 and he made G.D.entry and enquiry has been conducted. During the course of enquiry, it revealed that a case vide F.I.R.No.248 of 2025 dated 07.07.2025 was registered for the offences under Section 498-A of IPC and Sections 3 and 4 of D.P.Act basing on the complaint lodged by the petitioner on same set of facts on the file of Women Police Staiion, Saroornagar, Rachakonda Commissionerate, as such the petitioner case l-ras been closed with an advise to approach Women Police Station, Saroornagar for counselling. It is further submitted I that 3.d respondent has conducted enquiry into the above petition and closed the petitioner as a case in F.I.R.No.248 of 2025 was lodged before Women Police Station, Saroornagar with same set of facts and the same is pending for counselling.

In that view of the matter, since the respondent authorities have already registered a case vide F.l.R.No.248 of 2025 for the offences under Section 498-.4 of IPC and Sections 3 and 4 of D.P.Act, the petitioner may pursue the remedy for the implementation of the undertaking-cum- declaration dated 16.011.2025 as the un-official respondents have already settlecl in part.
