2. Heard sri Yadu Krishna sainath, learned counsel for the petitioner, Sri L.Ravinder, learned Assistant Government Pleader for Revenue appearing for respondent Nos.l to 3 and Sri K.Pradeep Reddy, learned Standing counsel for Grampanchayat, appearing for respondent No.4.

Learned counsel for the petitioner would submit that the petitioner is the owner and possessor of the house bearing No.2-212, admeasuring 605 Sq.yds in Sy.No.135, situated,.at Kannala Laxmipur village shivar, Bellampalli t&". 2 Manrlal, Macherial District (herein after referred as "subject property") by way of succession and his name was entered in gram panchayat records and he is paying property tax reguiarl-v to respondent No.4. As the subject property was in ditapidated condition, the petitioner removed here house and requesting the authority to give permission for construction of new, house and applied building permission and the same was rejected by respondent No.4. white the matter stood thus, respondent Nos.3 and 4 are trying to interfere into the property stating that the land belongs to the Government. Therefore, he seeks direction to the resp,rndents not to interfere into the possession of the petitioner over the subject property.

Learned Assistant Government pleader for Revenue and learned Standing counsel for Grampanchayat in one voicr: would submit that the petitioner was never in the possession of the property and without there being any docrLments, the petitioner demonstrating that he is in possession of the property, which is the Government propert)/, hence, seeks to dismiss this writ petition. t*

Having heard learned counsel for the petitioner, learned Assistant Government Pleader for Revenue and learned Standing Counsel for Grampanchayat and upon perusal of the material placed on record, this Court without mal<ing any observations on the merits or demerits of the case on the aspect of possession of the property, deems it appropriate to direct the respondent authorities to strictly follow the procedure contemplated under law by issuing necessary notice to the petitioner if so warranted and take appropriate action in accordance rvith law.
