Judgment

SMT.BOBBA t he Respondent s: GP FOR T he Court at t he st age of admission made t he following : ORDER: The petitioners are the members of the Managing Committee of the Agripalli Primary Agricultural Cooperative Society Limited, the 2nd respondent herein. Their grievance is that the President of the Society, the 3rd respondent herein did not conduct the meetings of the Managing Committee or the General Body, at least within the intervals provided for under the relevant provisions of the Andhra Pradesh Cooperative Societies Act, 1964 (for short, ‘the Act’) and the rules framed thereunder. Their apprehension is that that on account of the default committed by the 3rd respondent, the Managing Committee itself may be superceded for non- compliance. Heard the learned counsel for the petitioners and the learned Government Pleader for Cooperation. While directing notice before admission on 07-06- 2007, this Court directed the Deputy Registrar of Cooperative Societies, the 1st respondent herein to take necessary steps as contemplated under Section 32 of the Act for convening the general body meeting of the Society. It is represented that such a meeting has since been conducted on 02-07-2007. With this, substantial part of the grievance of the petitioners stands redressed. The apprehension of the petitioners that the Managing Committee may be superceded for the non- conducting of the general body meeting within six months can be allayed by directing that since the meeting of the general body has taken place pursuance of the directions of this Court, it shall not be treated that any contravention has taken place earlier to that date. The writ petition is accordingly disposed of. There shall be no order as to costs. Dat ed: 16-09-2008 L .NARASIMHA REDDY, J // TRUE COPY // .....
