The Court made the following ORDER: THE HON'BLE SRI JIISTICT E.V.VENUGOPAL CRIMINAL PEf,ITION N0.8743 0F 20/21 ORDER: This Criminal Petition is filed to quash the proceedings against the petitioners in C.C.No.640 of 2O2l on tl..e file of XXII Additional Metropolitan Magistrate, at Cyberabad, registered for the offences under Sections 498-A of IPC and Sections 3 & 4 of Dowry Prohibition Act.

2. Brief facts of the case are that on OT.OS.2O2I at 1O.0O hours, a complaint has been filed by the defacto complainant-Smt. B.Meghna, W/o.B. Saikiran, Resident of Gandhi Nagar, Ramalaya Street, Secunderabad stating that she got married with B.saikiran at Shobha Garden, Bowenpally, Secunderabad and it was arranged marriage. At the time of marriage, her parents incurred expenditure to a tune of Rs.35.O0 lakhs and that her fat-her paid Rs. 15.O0 lakhs in cash before marriage as and when demanded by the accused. Apart from that 80 Page 2 of5 tulas gold,O8 kgs of silver articles and ot aer articles towards dowry were given. On the der:l and of her mother-in-law, her parents gave open plot a lmeasuring 3O0 sq.yds at Sreenidhi Homes, Ghatkesar, t.R.District, one acre of land at Aler, Yadadri Bhuvangiri District and open plot admeasuring 250 sq.yds at Greer. City Ramoji Film City, Hyderabad. Out of their vr:dlock, the complainant and her husband blessed with z male child. Thereafter, the husband of the complainant her mother- in-law, sister-in-law, brother-in-law and ot: er relatives, all are residents of Jeedimetla, harassed h er mentally and physically demanding additional dcr r4r. Hence, requested to take action against them.

3. Basing on the said complaint. p.S, pet Basheerabad registered a case in Crime \1,t.487/2O2I , dated 07.O5.2021. Thereafter, L.W. 1 1 conducted investigation and examined witnesses and after completion of the sarne, laid charge sheet ir lainst Al to A.7 before the XXII Additional Metropolital Magistrate, f / \ Page 3 ofs Cyberabad at Medchal for the offences under Sections 498-A of IPC and Sections 3 and 4 of Dowry Prohibition Act.

4. Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for t] e respondent/Police.

When the matter is taken up for consideration, learned counsel for the petitioners would fairly submits that the trial Court has commenced trial and seeks liberty to these petitioners to raise all the contentions which were raised herein before the leamed trial Court by fiIing discharge petitions.

6. Recording the submission of the learned counsel for the petitioners, this Criminal Petition is disposed of granting the liberty sought for. Upon filing such petition before the trial Court, the learned trial Court shall examine the same on merits and pass appropriate orders, strictly in accordance with law, as expeditiously as possible, preferably within a period of three months from t!. .,f 5 the date of receipt of :r cci;, ..rt'this order.
