J Wp 22483 20 t8 aod batch after mutation of their names and recording the entries in the revenue records, when the pattadar passbooks have not been issued, they were constrained to make various representations before the revenue authorities and acting on the said representations, the Tahsildar uide Letter in Rc.No.B/3366 /2014, dated 16.09.2015, submitted a report before the Revenue Divisional Offlrcer stating that on verification of the records, the total extent of iand in Sy.No.1018 is Acs.180.00 guntas, and out of the same, an extent of Acs. 108.00 guntas is in occupation being cultivated by the ST and SC ryots since more than four decades and their names were recorded in the enjoyer column of the pahanies ol Sujathnagar village. It is also stated in the said report that from 1990- 9 1 onwards the names of Mr. Premkunar Jariyeli, Mr. Anil Kumar Jariyeli and Mr. Ashok Kumar Jariyeli are recorded as pattadars in the place of Mr. J.N.Jacob and Mr. Alexander Jacob. It is stated that in the field enquiry, it is revealed that the above .said persons were not found to be in possession of the subject land. It is further stated that, aggrieved by the said report, the petitioners have made an application before the Revenue Divisional ofhcer and the Revenue Divisional officer uide proceedings in Rc.No.Dl1944l 2018, dated 04.01.2018 directed the Tahsildar to conduct a detailed enquiry and to take necessary action as per the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 7971. The office of the District Collector issued Memo Rc.No.E3/454 7 12022, dated nil'09 2o22 stating that IC/C updation will be done in Mee-seva centre and directed the petitioners to approach Meeseva center to enable them to take further steps in accordance with law. When there is a dispute u,ith r egar-d tr the nature of i \ 8 CVB& J wp 22483 2018 and batch the land, its classification, extent and boundaries thereon and possession of the subject lands, writ petition is not a proper remedy to delve into the issues relating to the title and possession nor enter into the rights of either of the parties with regard to title and possession.

Learned Assistant Government Pleader further contended that initially when the petitioners hled W.P.Nos.9246, 9752 and 1O004 of 2016 before this Court, the same were dismissed with an observation relegating the petitioners to approach the competent civil Court and in the writ petition hled by the contesting parties also, this Court had passed the very similar order relega[ing them to approach the civil Court. When this Court has passed order after verihcation of the records, the subordinate Revenue Ofhcials are not having any right or authority to take an action contrary to the observations of this Court with regard to nature of the lands or right and entitlement of the parties over the subject 1ands. It is also stated that after disposal of W.P.Nos.9246 of 2016 and batch, the petitioners frled W.P.Nos. 10909 and 12562 of 2027 and on 23.06.2021, a learned Single Judge of this Court passed the following interim order:- " Heord. leanred. counsel for petitioners and learned Assislant Gouemment Plea.der. It is the case of the petitioners that their grandfathers were assigned the land to an extent of Acs.60.00 guntas each in Sy.Nos.1o18/o1; 1ot8l02; 1018/o3; 1018/OO/1; rol9lOOl2; 1018/OO/3; 1Oi8/Ow/1; 1O18/OW/2 and rOtS/OW/3, situated at Sujathnagar Village and Mandal, Bhadradri-Kothagudem District' It is the further case of the petitioners that the names of the petitioners' grandfathers have been recorded by issuing mutation proceedings in Rc.No.C/|610lSg,dated22.12.lg8gandtheirnameswerealsoentered in Khasra Pahani 1954-55 and thereafter, in Sessala Pahani ie., 1955- 58 and as such, the Government has considercd for allotment of the lands. Whereas, it is the case of the respcndents as per the counter- afhdavit that there are serious disputes with regard to the nature of the land, its classihcation, the entries made in the revenue records and also possession over the subject property and Batch of writ petitions filed by the petitioners as well as the unofhcial respondents were disposed of relegating the parties therein to approach the competent civil Court vide commonorderdated|7.o3.2o2linW.P.Nos-9246,9752and10004of 2016 and 34463 of 2018. The chequered history relating to these cases reveals that there are serious inter se disputes between the petitioners and the persons' who are in possession of the property and an enquiry has been conducted by the Tahsildar and Revenue Divisional Of{icer and batch of writ petitions have been filed and disposed of directing the petitioners and the unofficial respondents therein to approach the competent civil Court. The District Collector, without taking into consideration of the 9752' 10004 of observations being made by this Court in W'P'Nos'9246 ' 2O16 and 24lll of 2O2l and aiso the interim orders passed by lhis Court in W.P.Nos.10909 arrd' 12562 of 2O2l' has entertained the representations submitted by the petitioners and seems to have issued memo for uPdating KYC forms' In view of the above, this Court, without expressing any oprnlon i5. on Lhe inter se disputes pending between the parties or- their entitlement lor issuance of pattadar passbooks and consequenlial correction or amendment of the revenue records, deems it appropriate to dispose of these writ petitions with the following directions: a) The District Collector, Kothagudem Bhadradri District' shall issue notices to the petitioners and respondents' call for the records the land in Sy.No. 10 18 and its sub-divisions' and pertaining to claims of both the petitioners and the unofficial exa4gine the If the petitioners procluces the necessary documents respondents. satisfying the requirements for amendment of the records' the 13 CVBR.
