This writ petition is filed questioning the proceedings of the respondents dated
17.06.2005 made under Section 7-A of the Employees’ Provident Fund and Miscellaneous Provisions Act, 1952 (for short “the Act”), determining the provident fund contributions payable by the petitioner-company. It is stated that the petitioner has already preferred an appeal against the said order as provided under Section 7-I of the Act, and the same is pending before the 2nd respondent-Provident Fund Appellate Tribunal. The only grievance of the petitioner is that despite pendency of the said appeal, respondents have been taking coercive steps for recovery of the amounts on the basis of the Impugned order dated 17.06.2005, and as a matter of fact, prohibitory order dated 23.03.2006 has already been issued to the concerned Bank to freeze the account of the petitioner.

I have heard the learned counsel for the petitioner as well as the learned Standing Counsel appearing for the 1st respondent- Sri R.N. Reddy. Keeping in view that the statutory appeal is pending before the 2nd respondent, the writ petition is disposed of with a direction to the 1st respondent not to take any coercive steps against the petitioner till the disposal of the appeal, subject to the condition that the petitioner deposits half of the amount demanded under the impugned order dated 17.06.2005, within a period of four weeks from today.
